Title: bm loses yet another job...

Non custodial Bm has been employed as a legal secretery/paralegal for 4 yrs. I think she felt she would get some legal help from employers and somehow be protected from further prosecuton for her huge arrearage. Well, we have always left the support order the same from 1994, since she never paid anyhow, why ask for an increase. It was based on her job at the mall...yep, it's not much. So, about 6 months ago, they began garnshing wages! And SD is involved in activities that are anything but cheap...horseback riding lessons...wears glasses...is getting braces soon...and is cared for properly....we don't spend cs on ourselves is what I am getting at. Well, I found out todasy that she lost her job last month. We asked for a modification at the beginning of october. I spoke with the office that said they base the new amt on the past year b/c it shows what she is capable of making. Does anyone know if this is really how it works or will she be able to cry her way out of it...as she has any trouble. I think that she was fired, but who knows maybe she quit. Or maybe the law firm found out that she tells them lies about not having her daughter and that we are horrible people that lie about if she's paid. That would be hard to do considering that she has always had to pay only through the friend of the court. I guess they are the ones keeping the money and lying.
She lives in NC...will they still modify?

I would assume so, DH's was modified when he was laid off last year (MN).

She MAY be able to cry her way out of it, but I'm thinking probably not.  She was employed for four years, so it's doubtful she can claim lack of ability to work.
