Title: motion to stay
Post by: wallyworld85 on Dec 20, 2003, 06:49:32 AM
Just a quick question.  Last year when my ex got my daughter back when we filed for cusotdy in IL.  IL said that her motion to dismiss due to the jurisdiction was stayed until the time when FL either chooses to accept jurisdiction or denies it.

1.  Is there a time limit on how long it can be stayed with no court and ex prolonging?  It has been a year and three months so far and no new judgment as there has been no court date for FL to accept it.  (There has been two set--One was continued, the other one canceled because they offered settlement agreements, but now are refusing to sign)

Also, my lawyer thinks hers may not be hers any longer because he is not returning any calls (4 so far).

2.   If her lawyer is just messing around to avoid my xmas visitation (which was done successfully) are there any sanctions for me?  Could he be reported to the bar?
