Title: CS & Summer Vacation

My best friend has custody of her 4 year old. The father has standard visitation including 2 months over the summer. The father moved out of state and hasn't called or seen his daughter in almost a year. He does pay his CS.

My question is this...He is supposed to have his 2 months soon, but he will not take them. Instead he will leave her with the child and all the bills he was supposed to have for those months. Shouldn't he pay extra CS if he isn't taking the child during these two months?

Why should he pay extra?  The system is already working against NCPs.  My husband had to continue paying CS to his ex when we had my SDs full-time for two months--and we provided for all their needs while they were here.

Many states do include parenting time in the CS calculations, but at least here it is based upon the court order--not what actually happens.  Perhaps if your friend really wants more money, she needs to haul the ex to court, reduce his visitation and then ask for more money for it.  My suggestion is that she should be grateful that he is willing and able to pay CS in the first place.

Well, I don't think he should have to pay extra but I don't agree w/oklahoma's that she should be grateful that he is willing and able to pay CS in the first place, if it's his kid he pays, no being grateful about it. My BF & I are learning this the hard way that you just have to be the one to get in court first, espec dealing w/psychos.

From everything I've learned past week or so thru my research b/c of my BF's situation, people keep saying that visitation & support are 2 separate issues so wahtever happens w/visitation doesn't affect support.

Yes she should be grateful.  I know that it is his responsibility to support his child but I have a 10 year old who has never recieved one dime due to a parent that moves all across the country and works under the table.  I would be grateful for any help!

your friend was going to continue to recieve cs if the childs father took the two months right?  does that sound fair to you, really?  he pays while she has the child, and still pays while she doesnt???  what had she planned on using the cs for during those two months?  

yes, i too believe she should be grateful that she had a child with a man who is willing to pay support.
