Title: Very mad, need some advice..

My boyfriend recently went to court with his Ex for Child support hearing.  He was ordered to pay 640$ a month, plus another 400$ a month for childcare.  He's only bringing home 1800$ a month, and after this child support is taken out, he will only have 700$ a month to live on.  Our rent is 700$ a month.  Now, the support magistrate told his ex that because she's in school, and only working 20 hours a week, she doesn't have to pay for anything, and if she doesn't want to get a job after she's done with school, she doesnt' have to!  Now, I think this is so wrong.  There has to be something that can be done to change this.  This "woman" has gotten away with cheating the system, lieing in court, just about anything you can think of she's done and gotten away with.  When I had gone to court for support, they had told me I would have to pay for half of everything, even though I didn't have a job.  Now this is the same state, different counties.  How can they be so different.  I don't think it's fair at all.  The state is NY.
Any advice would be muchly appreciated.

The child support amount in NY in a set formula. He has to pay 17% of income for one child regardless of what she makes (should be a little over 300 for one child?)....BUT the child care should be rated according to BOTH incomes.  It sounds like the judge is letting her have extra while she finishes school. If you can not fight this now....I would as soon as she graduates....I seem to remember something about they can not take more than 50% of your paycheck...Maybe some one here can anwer that for you...

Thanks for the reply.  We went to see a lawyer today, and she told my bf that it's a little over 600 a month what he should be paying.  The support magistrate didn't take out for fica, and all the taxes.  And as far as the daycare, that's something that should be between the both of them.  Which it isn't.  He has to go back in May, and hopfully things will change a little.  Or a lot. lol
