Title: Writ Of Mandamus
Post by: Fair_Rulings on May 24, 2005, 01:29:54 AM
Has anyone ever filed a Writ of Mandamus in a family law appeal?  Do you know the names of any cases regarding family law issues where a Writ of Mandamus was filed?  I need to file a Writ of Mandamus to compel the Superior Court to do a Psychiatric Evaluation.  Thanks

Writ of Mandamus Form for California http://www.courtinfo.ca.gov/forms/fillable/cm010.pdf

I *think* that you are after what is considered a "traditional" mandamus
(see Ca. Codes http://www.leginfo.ca.gov/cgi-bin/waisgate?WAISdocID=56027314603+0+0+0&WAISaction=retrieve )

I am not familar with any caselaw off hand. If I discover anything I'll give you the info.

Thanks for the info but I was not able to open the //www.leginfo.ca.gov... web link and at the //www.courtinfo.ca.gov/forms/fillable/cm010.pdf it gave me a civil case cover sheet.  I need to file a Writ of Mandamus for a family law situation in San Fernando Court, Los Angeles.
