Title: Evidentiary Hearing
Post by: Dibella2 on Dec 09, 2003, 10:22:55 AM
Court has awarded DH an evidentiary hearing.  However, I am now at a loss as to where to go from here.

Has anyone had a hearing?  If so, what should we expect?  How does one go about proving that this mother is unfit AND the household she's in is no good for the children?  We can't afford a PI.

Any suggestions/experiences you can share would be greatly appreciated.

if there are proof that their house isn't fit, call the child abuse line, if there is police report same thing.

It's PREATY hard as even if there is proof, often judges don't want to change the status quo

DH has custody of the children during the school year.  She has them during the summer.  We have police reports and a number of other things.

In order to get the evidentiary hearing, we had to prove that there was endangerment and the judge said at the last court hearing that he finds sufficient evidence that shows endangerment.
