Florida boy accused of assault with rubber band

13-year-old suspended 10 days after confrontation with teacher

A 13-year-old student in Orange County, Fla., was suspended for 10 days and could be banned from school over an alleged assault with a rubber band, according to a WKMG Local 6 News report.

Robert Gomez, a seventh-grader at Liberty Middle School, said he picked up a rubber band at school and slipped it on his wrist.

Gomez said when his science teacher demanded the rubber band, the student said he tossed it on her desk.

After the incident, Gomez received a 10-day suspension for threatening his teacher with what administrators say was a weapon, Local 6 News reported.

"They said if he would have aimed it a little more and he would have gotten it closer to her face he would have hit her in the eye," mother Jenette Rojas said.

ALMOST HIT HER IN THE EYE!!! OH THE HUMANITY. Why, she might have been KILLED. Sheesh- the school is making it sound like this rubber band was a mortal threat. It *almost* hit her in the eye. Oooh, scary. What kind of pathetic little chickenshits is the Liberty Middle School hiring for teachers, anyway?

Rojas said she was shocked to learn that her son was being punished for a Level 4 offense -- the highest Level at the school. Other violations that also receive level 4 punishment include arson, assault and battery, bomb threats and explosives, according to the Code of Student Conduct.

So...let me get this right....shooting a rubber band is considered with the same seriousness as arson and explosives?? As serious as a bomb threat? What did I miss? Did they redefine the word "danger" while I was in the bathroom or something? Talk about your total insanity.

The district said a Level 4 offense includes the use of any object or instrument used to make a threat or inflict harm, including a rubber band.

Rojas plans to fight the ruling but her son still faces expulsion.

"It's ridiculous, it's a rubber band," Rojas said.

The school's principal could not comment because the case is still under investigation.

A district spokesman said there is still a series of meetings the district will have before Gomez is officially expelled.

Oh yeah, meetings. Gotta have a lot of meetings to discuss what a a horrible offense this was. Why, expelling him isn't enough- he ought to go to prision where he belongs, the murderous little terrorist!

I am in a city in Iowa and my oldest DD is in middle school. We too have this trouble in our schools. If my DD or other students are caught with a rubber band they are suspended for 5 days out of school.

Thats not even shooting the rubber band.......thats just having one. They consider it a weapon here too.

I think its nuts .........all over a rubber band!!

I hate to see what would happen if a student was shooting spit balls! LOL!

ACK!!! I am glad you said something. I just talked to my oldest son. He always has a rubberband on his arm. He said his middle school will alllow them to wear them, but not shoot them. I just told him absolutly NO more rubber bands, or wearing them. I can't have him getting suspended.

My oldest just finished a 2 day suspension from school.  For what?  Tossing a string of Mardi Gra beads to another student in class.  The student asked my son to toss them, he did and the catching student missed catching them.  The hit him in the side of the face.  They actually threatened to call the police and have him charged with assault.  He was also permanently kicked out of that class, his favorite one of all of them.  Gotta watch those assaults with colorful beads.

My DD had one on her arm and her and I both got a warning.....but were told that if she was caught with another one then she would be suspended for 5 days. She doesnt mess with rubber bands anymore.

In that case thousands of people need to be suing the State of New Orleans!! LOL
