Title: Mediation yesterday

Completely failed.

We have gone back to court many times before I ended up gaining custody of my baby girl. Now, in mediation, pb flatly stands on she wants me to give up primary custody,, forgive her arrearage, cancel cs on her oh,, and PAY her.

Hmmm,, ahhh, gee ,,,,let me think....NOT!!!!!


What pb didnt seem to realize, is she was not working from any kind of position. She offered nothing, and soundly rejected our offers.

We had offered expanded time IF she stayed in therapy, and gained anger management, we offered to reduce cs to 200 a month AND forgive arrearage. She thinks she'll get a better deal in court.

Soooooo,, docket call next month, then off to trial.

Oh PD!!!  I'm SO sorry!  I don't think you have a great deal to worry about in terms of custody of peanut ... but dammitallanyway!  You DON'T need that stress!

Bless your heart -- your PB truly is NOT the sharpest crayon in the box!  PAY HER?  LOLOLOLOL!  That one got me chucklin' big time.

Hang in there buddy - it's just another small boulder in the road for you to get over/around.  In the meantime know that we're all here for you to vent the inevitable frustrations if you want to do so.

Hug that sweet baby girl of yours for all of us ... and we'll keep y'all in our prayers and thoughts!

To be honest MK,, I won a dollar from my attrny. I bet her what pb was gonna demand and stick to, despite any offer we made. btw, the offer we made, was more generous than we feel she'll get in court.

So, it really wasnt a surprise how it turned out, BUT, we did try to negotiate in good faith.

I'm sorry to hear that it went so badly...MK is right, what a laugh!!  Pay her??  Hmm, that must have went over well...

PBFH in our case wouldn't even show up for mediation because she figured she would do better in court...so our court date is for May 17, and then it will be ALL OVER and perhaps finally, we can get married...
And by the way, the judge already overruled her requests with our lawyer, so court won't help her either..nice, huh??

Good luck PD, I hope it turns out well for you and your girl.

awww....come on, PD...why not?  You just pack up baby girls things, give her to mommy dearest, let go of all arrears and pay up, dammit!  Now don't you think that's the "right" thing to do?  

Gee...is she smoking dope, too?

Now don't you wish you had upped the ante?  Mebbe betting the attorney bill?  Do you think your attorney is gullible enough to fall for this "bet" again????  You could wipe your bill clean....lolol

Now, she hasnt paid support yet, right? Anything mentioned about that?

Correct, she has not paid cs. Flatly told me if I won custody, she WOULDNT pay it.

So, no surprises happened yesterday. We didnt expect her to come to any agreement.

The good thing is,, shes been refusing to pick up registered mail from my attrny, so we took that oportunity to go ahead and serve her with discovery requests after mediation ;)

wow... i just read that here in OH, they will look to see whether a ncp is behind in cs when determining a new custody arrangement.

I don't know about that, but I do know at the time custody was changed PD was not behind in cs and is less that 300$ .
The AG did not change the paper work till past the court date so it put him a little behind, not a biggy.
PB is on the way to well over 1k behind already and has not paid anything the judge ordered.

Does your mediator make a letter to the court regarding what went on during mediation?  If not, can you ask him/her to do that?  Sounds like it may help your case even more! Just a suggestion...
