Title: has anyone been through this?

We share joint custody with ex.  Went through custody evaluation prior to being married (we were together 4 years at the time), evaluator said that if he were to go to court at that time he would have sided with mom as she was married.  It did not go to court as we agreed to some of the terms she requested and kept joing custody.  We are simply not in agreement with some of the decisions ie: giving her medical decision making etc. as we feel our child needs (we feel) psychological help and she is not cooperating.  My husband and I share a child together who is now 2 1/2.  We only have visitation 6 overnights a month, reduced from 9  (one of the terms she requested during the evaluation).  We have been married and living all in the same house now for a year and we are wondering if going through the evaluation again would perhaps make any difference.  We of course would love to have our son with us more to strengthen the sibling relationship and we just miss him so very much when he is at mom's.  He expresses a strong desire to live with us however is not at an age that a judge would permit this.  What does anyone think?  Thank you for taking the time to read this.
