Title: Shared custody- when partner earns less
Post by: merrimer on Aug 19, 2009, 08:10:41 PM
I live with my boyfriend and we have a child together. I very much want to leave the relationship. He is about to go to graduate school and will be working part time and earning now significantly less than me.
If we have shared custody might I still have to pay child support to him since I will now be the higher wage earner? Or might his school and work commitments be grounds for me to ask for primary custody?
Thanks for any advice

you may have to pay. and  primary doesnt mean anything, primary can be 50/50 they will calcualte CS on time share and income. best thing you can do is try to be civil and talk with dad and both of you come to an agreement.

You will very likely have to pay. This has been my experience as the primary wage earner.
