Title: ex me wants to sign passport?
Post by: shellcode on Aug 14, 2012, 01:31:45 PM
We have a 6 year old daughter we both live in NYC.She has physical custody, we share joint legal custody, and i have every other weekend, and 2 weeks alternating every month. She wanted me to sign the passport before, but we came into agreement if she drop the order of protection( i was falsely accused of it) but it got settle. So now we had a lil dispute she gave me a hard for me to get my daughter on Monday, saying lies there etc, that nobody be home or what, and find out it wasn;t true because i called her father saying i'm going to pick up my daughter, because my ex girl lives with her parents, and my daughter grandfather takes care of her..

So after what happend she wants to me to sign? i said NO, she gave me threats( which the way i took it) saying, "I'm getting married and no way in hell Im going forbid u for me not to have my daughter at my wedding,"! Now i really don't trust her, so my questions is if she put me to court, would the judge make me sign? because i read i have that right to refuse not to sign...

If you sign it, then she can take the child ANYWHERE in the world, including countries who do not honor the Hague Convention.

So what if she can't get married on some island?  Tell her to go to Hawaii or Puerto Rico if she wants to go to an island.  Otherwise, I really can't see how a judge can force you to sign the passport application.  If she pushes it that far and takes it to court and the judge asks you why, tell him/her the truth....that there are plenty of other places she can get married and that past history (false OP's, etc.) tells you that if you give her an inch, she'll take a mile, and you cannot risk losing your daughter forever to some foreign country.  Your ex may try to convince you that she would never do that, but once you sign that application, the door is open and there's no way to close it....and she KNOWS that.

I believe she getting married over there because the dude don';t have papers ( I believe) So he trying to married her to sway himself to the U.S.A. But yea basically there are places could get married, if he got papers he could married her here.. and that judge saw us so many times in the past...

Well, she has a job here and family, and she told me once, she never live in DR, But with her angry towards me and can;t co-parent and sit down and talk and have a understanding, because she acts like a 14 year old instead of being 23 woman!!! I can't trust her

Then there's your answer.....if you don't trust her, do NOT sign the passport application!

Unless she is a serious flight risk, then yes, a judge will make you sign for a passport.  Since she has ties to the community (i.e. job, etc) you can bet on it...  Basically you are playing tit for tat and being as childish as she is.

sorry -- totally disagree.

MAINLY because of her outbursts and threats to move totally to the DR.

If it were civil, calm, cooperative.....yes.
