Title: bio dad remarried and now files joint taxes: does it affect child support?
Post by: balleros on Apr 20, 2014, 02:03:35 PM
I just realized that bio dad did lie about how he files. On our hearing, he said that even though he is now married, he files individually. Does this lie affect the amount he is supposed to pay?

He files married but separately -- and that's on him, and 99% of the time does not affect how much he should pay in CS.

he does this so that "you" don't come after his wife's income -- though again 99% of the courts will not touch or consider his wife's income (even though I got hit with that as the stepmom in NV -- my income was considered marital property in the community property state....and oh boy!)

By filing married and separate, there's stuff that he can't claim.....and I am willing to bet that THEY file married joint down the road so that he can reap the full benefits.
