I've posted several posts on this site.... I married a doozey! Trying to get her to agree to a seperation agreement is proving to be impossible. Anyway, he's on the mortgage and the car and I would LOVE to give her both but...... he has HORRIBLE credit. What options do I have if I get someone to buy the home and he refuses to sign?
you have to get the order to say that both parties will comply with the sale of the house....
Then when he doesn't sign, you do a motion to compel (force him to sign)....and the court can also order a registrar's deed -- or at least the name is close to that.
I know someone whose DH didn't sign a quit claim deed -- and since the original decree said it was hers and that all parties will cooperate to sign appropriate paperwork, the judge awarded her a deed without his signature.
