Title: Father's rights in NC

I am active duty military and recently my wife left while I was at training in VA and took my son to FL. My son is 11 month's old. Does anyone have any experience with this in NC or have any good advice.

You can petition family court to have son returned until a custody hearing but others will pipe in about military piece and active duty. There are laws that protect active duty in family court and custody. Were you both originally from NC? Are you back in NC now? how long?

File in NC immediately so that she can't establish residency in any other state.

the SSCRA will protect you also to a degree if you find yourself fighting in another state.

BUT if you file first for temp then permanent custody, jurisdiction should stay with you.

Hopefully you're not going to get deployed or transferred soon.
