Title: anyone need a laugh? bm has proposed a visitation schedule...
Post by: doood on Mar 31, 2004, 07:10:49 PM
bm moved 450 miles away, two weeks later, she filed a motion to relocate my son. by the time the 'emergency' hearing gets in front of a judge, she will have been down there nearly two months. through her atty, bm has proposed a visitation schedule as such:
one weekend per month, alternating between bm's and bf's city of residence. when in bm's city, 8 hrs visit on saturday, and 8 hrs visit on sunday, in bm's home. when in bf's city, 8 hrs visit on saturday, and 8 hrs visit on sunday, in BM PARENTS' HOME. yeah, nothing like 16 hours a month to let a baby bond with his father, eh? i guess after getting 30 minutes in the last ten months i should be thrilled. none of the following holidays were even mentioned: memorial day, labor day, father's day, son's birthday, or vacation time.
the funny thing is, this proposal was ten times more generous than what i was expecting. i truly believe her atty put things in there above and beyond what bm would agree to, knowing 100% that i would not accept.

First thing I would ask her, if it were reversed, would she settle for nothing?

Put together a good Parenting Plan to present. Include the Holidays.
Go for EVERYTHING you would like.

I would think the jurisdiction would be where you are. The child has a six month residency. That is pretty general. Maybe she can move, but she could be stopped from taking the child with her? Something to think about.

i'll be meeting with my atty on tues to put together a plan, custody pre-trial is set for 4-7 (third time is a charm???)
good news is that the RO was granted, and neither of us is allowed to remove our son from the state for more than two weeks.

I would still put together a good Parenting Plan. Give the Judge something to work with, showing your concern for your child. It will also show you are more willing to work with her, then she is with you.

Congrats on the RO!
