SS (charged with Child Rape in the 1st Degree) is pleading guilty. The polygraph was not his friend, but we found that he has had no other victims (than DS1 and DS2). Sentencing is in Dec. I am a little miffed that he made the younger boys wait until 3 days before court to decide to take a plea bargain.

And then..

My brother called me out of the blue last night. He has been the perfect father and NEVER said or allowed anything bad to be said about his ex if there was a remote possibility of his 2 sons hearing. (He is on the east coast and she is in WA with the younger son (age 17). So it was quite a shock when he told me last night that if he had killed his ex when he wanted to, that he would have been "out" last year instead of looking at CS and PA(S) until Mid June 2006 when my nephew enters the Navy.

I laughed out loud when I read what your brother said.  Truth is we all think about it at one time or another.  He is on the home stretch though, I hope he is feeling some relief from knowing that.

What exactly was the plea bargain he took?  Can he come near them ever again?  Is he in a detention center?  My nephew was sent away to a "camp" I guess you would call it.  He wasn't charged with what your SS was charged with though, it was less, but he was gone for like 5 years or I think until he was 16, because I remember he could drive when he got back.  I am glad this is coming to a close for you family and the healing process can begin.

Is BM still in denial?

SS is pleading to either 1 count of rape of a child in the first degree or atempted rape of a child in the first. He is pleading out for a chance at probation and mandatory sex offender treatment (SSODA - Special Sex Offenders Deferment A-somthing)

If he fails to attend, he will get thrown back in juvie.

He becomes a level I sex offender

As for whetehre he is allowed to see the younger kids, we are hopeful a condition of his release is that he will not be allowed around any child 2 years or more younger than him. That will preclude him frm spending time with any cousins (since he prefers family members).

Don't know for sure.

I know what a struggle this has been on you, I am sorry I haven't been around much.

Well I hope he can now get the help he needs and that his mom will realise what is going on.

I hope he is not allowed around the kids in the family, what the little ones have already gone thru, hopefully they can also overcome this.
