Title: Collecting against a Judgment???????

we got judgement last year agst bm for over $4000 in legal fees/etc... She has refused to pay, we've sent at least 3 certified letters.

 We cannot claim this on our taxes as a loss b/c it was family court-BUT, if we can get this moved to Civil court for a judgement, we CAN claim it as a loss.

We could really use this tax break!

 However, I can't find any help in getting paperwork for this to go Pro se.

The county I live in is small, went to courthouse and they were of NO help at all. ANyone got any ideas?

I don't know where you get your tax advice, but you should look elsewhere. The fact that someone owes you legal fees, doesn't entitle you to write them off if they're not paid, regardless of the court involved.

Legal fees are deductable when they are paid in the pursuit of the production of income, or to preserve income already earned. Unless your legal fees were for spousal support or alimony, or they were paid to perserve a corporation or other business entity, they are not deductable.
