I think you said the custody order is Indiana, if it is then you must have an lawyer that parctices law in Indiana. Your best bet is an lawyer near her area so you wont pay for anttorney fees for Travel.  The biggest thing I see is the mother will be granted supervised visits at first etc. like I stated in my first post then the visits will phase into regular visits because its been so long and your daughter will need to get to know you and your family. How offten can you go to where you child lives?  I don't want to damper your rights its just this will be hard at first but it will get better you have every right to see your child as your child has every right to see you and your family. Shop around for a lawyer that will fight for you also ask for joint legal rights and visitation. The sooner the better it will take a while to get a court hearing and I'm sure it will take more then one.  This site is helpful so look aruond the articles etc. The other boards on here hare helpful too.

You need to keep everything she sends back as proff, document what you do, calls, letter etc., you need to go to the other boards to learn how to go pro se (no attorney) this will be your best bet. You need to file for visitation, she will more then likly get supervised at first if its been a while since you have seen your child, if you want to get some where ask for supervised visits that led in to unsupervised in her area that leds to vistits in yours. The guidelines here for long distance are spring brake, 7 days of x-mas vacation, and seven weeks of the summer.   How old is the child? How long has it been since you have been able to visit?  This will be a long process but you must be willing to follow through and you will get visits per the guidelines.

Sorry must have hit reply,instead of post.......

I couldn't tell if they are trying to change the laws or not....I know that my state started to take into account the over nights with the NCP when they calculate cs.....however the fairness I don't know.

Truthfully I don't understand cs as dh and bm do not have a cs order...I know its for the child(ren) all that...but the tec. parts confuse me......most of the time to me anyway they do not account for what the NCP needs to raise the child on their time too.....

Most of the time they will just deduct her payment from what dh owes her. BUT it must be set up that way I believe.  So you need to call...this will be best for you anyway unless you can/did pay off all the support now.

ex. dh owes 1000 in back support but bm is now ordered to pay 100 a week to dh now. Well instead of her paying dh they just take 100 from the 1000 each week until its a 0 balance then she will have to start paying your dh.

I didn't see your reply, it is in the co about taxes. I was just wondering if there were a way to come to an agreement for the medical part. OK at this time we are working on an amendment to the co I was wondering if in the amendment we added that both parties agree to be 100% responsible for ins. and non covered medical expenses during their physical custody period.
But the out of pocket cost is on the work sheet and a poster on a different  board said this would over ride the new amendment ie. because cs would be filed after......(we wouldn't have to include the ins on there).
I will lay it all out for you with our income and family size we get medicade also for the kids. My dh can to get ins for the kids at work but we could not afford it and our case worker said they can not force him do to our income.  But ss is not covered here on medicade as she has physical custody, but she has him on medicade there (she did but we think she gave it up).
So the bottom line is that we would spend more on medical bills while ss is there then she pays in support all year.
I may have to ask soc. but he may not have time to review the guidelines.

If I start this you would think I am nuts but here goes................now none of this is 100 % positive but none the less, we do know she worked at Wal-mart down there and Mazio's Pizza (she was still there before the summer but not anymore).  She testified in court she was going to school to become a cna then to be a nurse practitoner (sp?) in  late 2002, now keep in mind she told us this in 2001, so did her gp's several times. I talked to her on the 13th of this month re medical issues (she and ss had been in a car accident over the summer and did not iform dh until a week later, nor did she have ss checked out because the state of Missippi kicked every one of medicade?) she told me that she was a sub. teacher and that she is going to school to be a teacher. I am sure there is no way to find that out on our own, but thats what she said....................she even told dh this on the 4th of this month he doesn't believe her but ya never know.

As for claiming I am sure if we pushed this with the irs she wouldn't be allowed to.....this is our year to claim. And next year if she has no income we could claim him (or at least this is what our tax perpairs say and to my understanding of the irs we could), but we never know if she is filing, has income as she is not required to tell us. I also found out from the irs that she can not claim the unearned income credit that goes to dh the problem is we don't know how to trun her in because the problem is that with dh income level and we have (4of our own) we get all the deductions and the unearned income credit so really it does not change our taxes but I also feel see shouldn't get to cheat the gov. That just my pov. But she is getting prob. 500-1000 extra she shouldn't e/o year.......

that this is the link to our cal. the guidelines are over to the left,,,,,,I do understand most of it................but I was just wondering would it be out of line if a cp would bring this issue up to the ncp. Or should dh just serve her, i know we could even have our state do this on behalf of ss, I just don't want to stick it to her unless it has to come to that point. Plus I just thought of this her attorney is free for her ,,,,,,so this could be drug out. didn't think about that..
