Hi All,

During a very down time in my life, I was served papers while being held on bail for Assault.  No excuse, but wherever my head was at the time I do not remember what the were for.  Possibly family court.  Possibly papers stating that the X took sole custody since I got arrested.

Since then, nothing has changed.  Still paying 1200/month in CS, kids with me every weekend, etc....

Now the EX is threatining that If I dont increase payments, she and her wife will move themselves and children out of country.  She states she Sole, so Im guessing that was what the papers were for.

again, I was in a very bad place and it was irresponsible not to pay attention to the papers.  It was like "who gives a damn"?

Would I contact the local Family Court for copies?

Im in MA.

Foxboro area here.  Yes, I need to contact a lawyer.  Mine cost me 10k and it was the EX decision to end it all.

I was served some type of papers 2 years ago when I was held on bail.  I was so emotionally out of it, I do not even recall what it concerned.

My next step is to call New Bedford family court and see if I can get the low down, then take legal action from there.

I lost my license for a year, on parole until May, probation until 2008.  All Misdemeanors, thankfully.

I do have a strong family network in MA.  Lots of family, cousins, etc....

I will update everyone on how it works out.

My sleepless nights are due to plans that she will not share with me.  She has already asked for $$$$$$$, so I dont know what is next.

I received a letter from Dept. of Revenue yesterday stating that my application was "Approved" due to financial hardship.  Now, I am just waiting for a court date for modification.

Also, the letter stated that levy's had been lifted off my financial sources.  Banks, etc....  Could this mean I could possibly process my taxes and expect a refund without it getting intercepted?  Not sure.

Also, monies that I had put into the children's college fund during the months of October, November were levied from the state and paid to the X.  This equals over $2500 and now that is down the tubes..  X and wife immediately took week vacation, and I am still responsible to save for the children's education.

I receive transistional aid temp. from the state.  Insurance, food, and small amount of monthly cash.  90% is spent on children.

I do not want to report to  the IRS and open a can of worms.   But, owning a 350k townhouse, 400/month car, and high weekly maintenence.  Wouldnt the state like to see some income coming in?

Again, she is in a cash business.   She has a wife, but, she is in the same exact biz.

Just want what is fair..

Child Support Issues / CS Mod in MA

Hi,
I live in MA.  I filed for modification due to a criminal problem that caused me to lose my job and license.  I have continued to pay all support except for 3 months while I was incarcerated.

The modification is due to my income going from 6 figures to practically minimum wage.

My Ex is a personal trainer making 40-60k off the books.  She files no taxes and is paid in cash.  She is a part time nurse and does report about 20k/year in those wages.

I never cared in the past about her unreported income due to my job and child support was not a problem to pay, (1200/mnth).

Should I report her to the IRS to help my case on modification?  If so, should I hold off court date or let my current support continue into the arrears?

This is in MA

My decree states that I have visitation on Wed, Fri-Sat P.M. of every week.  I filled out forms for CS mod. due to her not reporting a 40k/yr personal training business.  Dept. of Revenue agreed with me and sent a letter to this situation to myself and to her. We received this letter this week. She went nuts.  Court date still to be set.

So, she continues to deny visitation.  Had phones shut off.  Kids IM on internet shut down.  Threats to move her to another state with kids (against decree).

I filed a contempt of court motion a week ago.  Reason was she has violated the divorce/visitation decree 17 times since the Holiday's.  Rec'd clerks summons today and was ready to send to constable for serving tommorrow.  Court date is 3/13.  I was going to send in the summons to the constable for serving this afternoon.  Good thing I did not.  Police informed me that if I did, I was violating the order since it was time stamped at 12:07p.m. today.  Could have been locked up for months.  She would have been served and I would have been in violation due to contact.

Will my Contempt Summons help me in this RO trial?  She states the children are afraid of me.  One wants to live with me, the other is always upset at me because I limit his time on the internet, etc....

I guess I need a lawyer now.  Not sure what that will cost.  Any advice?

Custody Issues / Parenting and Jail

After 18 years of marriage it went down the drain.  The X had an affair with another woman, divorced me, married her, (live in MA).

Long story short, the divorce decree states 50/ legal and physical custody.

I got in trouble about two years ago.  Charged with A and B and sentenced to 9 months in jail.  Served 90 days and released on parole.

I now have a menial job until i get my license back and parole is over (May).  I do have my two children every weekend.  

I have kept current on all child support since my incarceration.  My ex is threatining to take the children out of state because she cannot afford MA.  The kids do not know this.  She has basically asked for double child support If I want the kids to stay in state so I can have my weekends with them.

I have been besides myself and just trying to get by since this whole mess.  She tells me that she now has SOLE CUSTODY since I went to jail and am on parole.  She states I have no visitation rights and she is letting them see me on weekends to "be nice".

I know I have to contact a lawyer ASAP.  Possibly an Emergency Restraining Order to prevent her to take them out of state.

I do not have many assets, (120k), living with family until parole is over, (a few more months).

I never received any court notification that I lost any custodial rights when I went to jail.  I certainly can understand that I may have, just have no clue.

I will consult with a lawyer once I save some money.  My assets are tied up in a home I am selling.

Any help/advice would be greatly appreciated.

Also, she is using a lot of PAS against me.  It seems to be working on my 12 year old, but not on my 10 year old.
