Most if not all states have whats called Presumption of Paternity.  If they were married when the child was born, then your husband is the father in the eyes of the courts, whether he is the bio father or not.

I have had him documenting sinse he decided that this relationship was not going to work out.  I am by no means new to the fathers rights life! :)

We know its going to be a long hard struggle!

Yes, he has intentions of leaving as soon as he has established rights to the child.  He also intends to get custody.  Told him its not going to be easy, but I think he has a good case against her, and with him already having full custody of two kids, that has to work in his favor.

Father's Issues / Claiming Paternity - Michigan

My nephew is expecting a child in October with a woman he has been involved with for 2 or 3 years.  They are not married, and she is legally still married to someone she  hasn't seen in 7 or 8 years.

Michigan has a assumption of paternity if the woman is married at conception or at the birth of the child.

I have looked at Michigan laws and the Affidavit of Parentage, and yes, they can sign one, but the way I see it, it gives him the right to pay child support and not much more.

Is there anyway he can get rights to the child as a parent, without having to go to court?

He has custody of 2 kids from a prior relationship and when he got custody of those kids, he had to go to court and have the judge declare him the father, even though a claim of paternity was signed at the childrens birth.

Any suggestions are appreciated!
