You have lots of options. If you have to close 2 nights a week, then don't take your son those 2 nghts. It would help if you put down your current schedule. Unfortunately, you need to work your job around your kid. There is no guarantee that the job you have now will be the job you have 6 years from now. You can't go back to court to change the schedule every time your job changes. You get the custody/visitation agreement and then tell work , I can work XX day and I cannot work XX day. If your lawyer says take her to court, then take her to court. She doesn't know what the judge will and won't do, she's just trying to intimidate you.

Who said you don't have a chance of winning? The ex, why would you believe anything she says? When you go to court, you'll both have to make sacrifices. I would also recommend that you, literally, start documenting every single little thing she does and doesn't let you do. From the date to the amount of time. The judge won't be pleased.

Thanks guys. One of the accounts is our tax refund and we already divide that by 50%, so that one is safe. I went ahead and asked my lawyer's assistant about the other one. I told her that I can provide proof that I opened the account after our separation, so hopefully, I'll be ok with that one too. My intent was never to hide it, but I just don't feel like he is entitled to half of that when I, meticously and frugally, saved to build that emergency account for me and the children.

Hey Socra,

quick question.

I am going through divorce/custody. And I have to update my financial affidavit. However, I currently have 2 savings accounts that I didn't have before, with good amounts of money in them. I am afraid that if I list those as items owned; that it will have to be shared with xhubby. That money is money that I have saved, meticiously, since our serparation. That I worked hard to do and I don't think I should have to split it with xhubby.

Is there a way to list the money without it being a marital assest, thus needing to be divided. I think that when xhubby sees my affidavit, he'll want half of that money.

Thoughts. Suggestions.

my name is the only name on the note and the lot rent. I am concerned that since he's D.L. prolly stills states the house address, that that is what he coud use to have to locksmith open the house; as proof that he lives there.

Hey Socrateaser, just a few quick questions.

My husband and I have been separated for a 3+ months. I have sinced changed the locks on the doors so that he can't come take anything without me knowing. So my question is

1. Am I in the wrong for doing that?

2. Does he still have a right to come into the home, even though he longer resides there, since we're still married? (I filled for divorce beginning of October).

3. Would he get in trouble by the law if he got a locksmith to open the door when I wasn't there?

I have no problem with him getting his things, but I don't want him in the house when I am not there. Thanks.

Thanks for everything. I am in the process of getting a letter from my pediatrican in regards to the exposure to smoke. I am also going to ask for a letter from another Dr, who just prescribed my daughter an anti-biotic for a cough she came home with after a week long visit.

Ok, so I talked with my current lawyer and told him that I want him to file for an expedited hearing on grounds that the mediation is over 3 months away. He said "we already did that, it got denied." He also said that the judge knows mediation is backed up. So basically he was somwhat curt with me...

I am thinking about getting a different lawyer and have consulted one already.

What kind of questions should I be asking the new lawyer?

New lawyer disagrees with my current lawyer saying that we should be able to get in front of the judge within 2 weeks...

Any thoughts or suggestions would be helpful. Thanks!
