and my term "deadbeat" does indeed apply to some parents.  Not parents who fall into hard times and are loving involved parents.  

DH's BM owes $13,000 now over almost 5 years.  The State just doesn't seem to be too hard on her.  I think if it was DH, he'd be in jail by now.

Serious controversial question.  Do the judges take it easier on women who haven't paid??

If you were a woman and it was the Dad not paying a cent, would the attorney say the same thing?

Yes, it's hard to get blood from a stone.  Yes, raising CS issues could and most likely will have other consequences...more involvement or a pathetic attempt to get custody back.  

However, it's not OK to have a child and not be financially responsible.

Go for it - use your State child support collection agency and be prepared for them to take a long time.  No sense in paying an attorney for child support because you will only get the money back to pay your lawyer so it's a moot point.

If anything maybe she will get scared and agree to a "settlement" outside of court but you can submit it so it's official.  Go through the State dispersment unit no matter what the conclusion.

BTW, you are talking to someone here with a DH whose ex (BM) owes close to 14,000 in child support and she has gotten off so easy in court it's hilarious.  She's even been found guilty of contempt and nothing...no jail time (yet) just a little slap.  Her arugement is that my DH makes enough so why should she pay anything?

The NCP biomom in this case is way behind in arrears - approaching 14,000.  In the past, IRS returns were intercepted to apply to arrears.  This year, biomom claims that the IRS return was grabbed by the government for her outstanding federal student loans.

There is a current court order stating that she was to turn her stimulus check over to the CP.  She claims to have not received it.  The question is - if there is an outstanding federal student loan, and massive child support arrearages, is that money split or will it only pay the loans back and not the CS arrearages?

How can you tell if she cashed it herself?

Will this be garnished for back child support arrears?  Does anyone know??  Will it require a form to be filled out or will our 2007 tax forms tell the government all they need to know and who qualifies for what?

She now owes over $8500 in past due support.  My question is this: if she knowingly didn't file her income tax because she knew DOR would keep it and send it to us, is that also evidence that she is avoiding paying, even though she could if she really wanted to?

I hope that you get it - sending good thoughts - when is court?

And heck yeah, if it's left up to the judge, you can go nutso and never really know what way he/she is going to rule on until they make the decision!

is that the CS is for the kids - in order to get a retroactive amount, you'd have to take money back away from the kids for when it was "overpaid" - the court is not going to make your kids owe you.... read more about the Bradly Admendment I posted.

I would be susprised to hear that someone has gotten retro for a downward mod. but ya never know.  As far as FL goes it is whati thought I read once. but now I can't find it.  I still say look at that link I posted ...

it is in there as plain as day for Florida that you can never go retroactive for a downward mod.  Check your State.
