Oh, I almost forgot.
Start keeping a diary of everything that is happening.
Get copies of all police reports CPS investigations, etc.  While they can still find them.

I finished reading the other post at the emergency hearing, your attorney can request that your daughter speak to the judge in private chambers.  Your daughter can then express to the judge where she would like to live.

You technically don't have to relocate.  School is out in a few weeks, daughter coudl remain with grandmother until the end of the school term and then start a new school where no one has seen the charges against her stepdad and mom in the paper next year.

My hubby's ex lives in IN with her new husband, Hubby and I live in TX.  After not seeing his two sons for three years during a visit we learned their was domestic violence in their home.
We hired an attorney the next day and filed an emergency ex parte and a protective order, neither mother or step-dad was allowed any contact with the children until the court hearing a few weeks later.
You may have to file in the state your daughter lives depending on jurisdiction, seek an attorney's advice ASAP.
It sounds to me that the mother need to be thrown under a bus with the stepdad.  I'd die before I left some knowingly hurt my child.  You have to fight for yours.
You also need to make your daughter realize that her mother's financial problems are adult problems and shouldn't be talked about with her.  Some parents just don't understand what is and is not appropriate for a child.

General Issues / Background Checks ???

OK we are going back to court, and I would like to get some background checks on my hubsand's ex.  In the original custody battle (that we won) about 4 years ago, She kept bringing up that DH filed for bankruptcy.  I have recently learned from her relatives that she files evry chance she gets, that there is a current CPS case open on her, and she has been working since right after we gained custody at the same job although she continues to tell us she is unemployeed.

Are there are good services out there?  I don't want to spend a lot of money, but I would like to know what services you have used and if they were any good.

Which court has jurisdiction???  Where were you divorced?

If tarrant county has jurisdiction, I would definitely see an attorney about modifying your custody arrangement.  Actually either way I would file for custody.  
I would get your son in counseling ASAP.  At 9 a judge won't talk to your son about his preferences, but he/she will speak with a counselor.
Also requesting that the court appoint an attorney for your son or have CASA involved can be very helpful.  If Tarrant county has jurisdiction, I know of a great counselor and would be happy to recommend him.  If not find a counselor in Tyler that is willing to go to court.
Start keeping detailed notes about where your son is and how often he sees you and his mother.
Is the grandmother willing to help you gain custody?  
I don't think it would be in the child's best interest to force him to return to the mother.  It sounds to me that your ex doesn't want her child, but doesn't want you to have him because she would lose child support and have to pay.

If the grandmother's health is failing, I wouldn't waste any time in getting started.
