Massachusetts State Forum / CS Guidelines review

Anyone know when the MA CS guidelines will be finished reviewing?

BM is on welfare.She has a paralegal degree,but since ss is 3 1/2,she doesnt have to have her income imputed into cs until he is 6.She lives with her bf,his dd and ss.Her car is in her mothers name,so on paper it looks like she has nothing.She receives cs and welfare.Is there anyway to report her and for welfare to see she is living with someone who has an income and she has an asset?We are in MA by the ways.Thanks(I dont want to go down to the welfare offcie,so I was thinking maybe a letter?)

I am trying to get my gf to file for cs from her babys father.How long after she files for it will it take to actually get it? She lives in Massachusetts

I have a question.Pending bm(as long as she doesnt change her mind again) They have agreed to 50/50 custody.Neither one of them is working right now,bm collects welfare as well as cs.Would the father be required to pay cs,even if he got a job?

I am located in MA.

I read somewhere that a person included in their prenup agreement that she will not be responsible for supporting her new husbands child from a previous marriage.

IE,they cant take into account her income when determining child support.

As far as I know in MA,they dont take into account a spouses income,but I would like to cover my behind..lol

My questions are:

1.Can i have a prenup with this on it and it uphold in court?

2.If not,how would a new spouse protect their income from being taken into consideration when a cp tries to raise child support other then not marrying?

Both parents reside in Massachusetts.Court cases are held in Berkshire County.

Father has EOW visitation with joint legal and child lives with bm.Father pays support on time.has all year.

bm worked for 6 months out of this year.Rest of the year she has been relying on cs and welfare to support her.

bm and father were never married.They do not have in the court order who claims child on taxes.bm has let her mother claim the child one year,but wont let the father.

Now child doesnt live with father,BUT he provided more then half of the childs support this year since bm only worked 6 months.She wont sign form 8832 to let him claim the child.

From what I saw on the website,it looks like father might be able to claim child since he provided more then half of the support this year.

1.If the ncp claims the child on the taxes and bm does,who will have to amend and redo them over?

2.Does courts usually agree to let parents claim child everyother year,or is that only sometimes?

I have never met my two half sister from my father.I came into contact with their mothers address,and her husband called me.

Long story short,I dont know if he will ever let me meet them.Their mother lets everyone run her life.

I live in Massachusetts and as do they.We are all in Hampden county.



My questions are:

1.Can i receive siblling visitation rights?

2.Dont I have more rights then their stepfather to talk to these girls?

I have a child born out of wedlock.I mailed a letter to the county clerk for a copy of the birth certificate and receieved a letter stating since parents werent married at childs birth and I was not on the birth certificate,it is not public.

Court is in Massachusetts and all parties reside in Massachusetts.


My question:

1.Do I have to pay to have the birth certificate amended or does the birth mother,since it is not my fault I am not on it.

Sorry,but I have one last question.How would I go about prepaying child support?It is taken directly out of the check from the start,and I dont know how long it will be until a job is found,so I want to cover my bases.Is this possible?Thank you.Oh also,I have sent 2 letters(ones i have used from this site)to childs primary care provider to request medical records,and have not heard back.First on was sent at the begining of June.Arent they required to provide me with this information since I do not have a court order from denying me of medical records.In fact,I have joint legal custody.Thanks again

I am the ncp and the cp lives almost 2 hours away from me.if i bring this to court to have cp meet me half way for visitation,is this an unreasonable request?I never lived in the same city as cp,i just met cp when I was in college in that city.long story short cp got pregnant and welfare took me to court 8 months later because cp didnt know who the father was.There is nothing in any court order to state who provides visitations.I have been doing it to see my child,but will not be working at the begining of next month,and due to high gas prices,cannot afford to keep going back and forth.cp states she doesnt have to and doesnt want to meet me half way.she is now on welfare and says she cant meet me at all.I read somewhere on this site the courts like both parents to make an effort with transportation.I know the moving parent is suppose to provide transportation most of the time,but what if they never lived in the same city to being with?Thank you

State:Massachusetts

The birthmother will not give me nor my husband his sons social security number.I do not have it due to they were never married.I have written several letters to ss primary doctor for medical records to obtain it,but the doctor will not respond.She will not give us any information on him,and child was born out of wedlock,so I still need to find out if fathers name was ever on birth certificate.Were can I start?Thank you

My df finally got ss social security number.I want him to claim him on his taxes since bm and her mother have been claiming him every year.df and bm were never married,so he doesnt need a 8820 form signed by her.Now bm has been on welfare for half of the year,which means she is not supporting him,the state is.When they both submit their taxes,will df get the money because he actually supported him and can prove it?

We just finally received ss medicals records,but his social security number is not on there.I thought this would be on the medical records.Thats one of the big reasons we requested it.Any info?TIA

We do not have any information for my stepson such as birth certificate,social security number/card,or medical records.When bm has been asked for these things,she said he is the father so he can get the information himself.Every site I look on to obtain social security card needs an id(childs medical records,etc) and birth certificate.They were never married,so I dont know how he would go about getting the b.c because its not a public record and his name isnt on the birth certificate.Shes is just a pain in the you know what and wants wants wants,but will not provide him ANY info on ss,even though he has joint legal custody.Any suggestions besides having to bring it to court?

Hi everyone.To male a long story short,bm refuses to meet my fiancee half way  in transportation.BM lives almost 2 hours away,and my df never lived in her city.Someone said because it wasn listed in the court order that my df is to provide transportation,no one is 100% responsible for it.Well what do you know bm up and quit her job,and now says she has no car.Well with the gas price hike,I think its awfully extreme to expect him to pay $80 everytime he wants to see his son.Anyone have any possible suggestions fro help?She is collecting welfare now,so she is crying poor as well.

Custody Issues / 50/50 Custody and school

 have a question and need to know if anyone else has been through this before.bm agreed to father for having full time custody,and now she is saying she has had him his whole life and she cant stay away from him that long.whatever,she is always asking when is he coming to pick him up..never any love or motherly anything towards this child..this is coming from someone who has given him a hard time about everything the past 3 years.The father was sent a letter by childs doctor stating he is way behind in alot of things and has told mother several times child needs to go into an early intervention program.Well,when he asked her how they were going to work this out with them haveing him every other week and schooling in september,she said he doesnt need to go to school yet,and when he does he is going to one in her town.Now,is the father really wrong to be mad that she just up and decided where child is going to school without asking him since they have joint legal.And he is expected on his week to drive 2 hours just to drop his child off at school then drive back another two hours to pick him up?What happens in a situation like this?

Ok last weekend bm agreed to giving my fiancee full custody and said they could start at the begining on October.Well he tried calling her a couple of times this week with no response except one voicemail.He sent her a text yesterday asking what else she wanted tot alk about and she replied with we will talk next week.Well he replied with what else did she want to talk about becasue his lawyer wanted to draw up the papers.Well then she said no.So he tried yet once again calling her and now she wont answer.My fiancees father wants to watch him most of the time because we wrok,but not only that,we thin he is being abused by either her or her boyfriend.The only thing is,if we call dss,I am sure she will pull the not letting him see his son crap.We think its either her mother that told her no or she realized she wouldnt be getting child support and have to get off of welfare and work now.Any advise?

Father's Issues / Birth Certificate question

My DF didnt find out he fathered a child until ss was 8 months old.He doesnt think he ever signed a birth certificate and the bm doesnt know if he is on there.How would he go about finding it out without having to pay for one?
