Dear Socrateaser / End of my rope
Mar 05, 2007, 06:49:53 AM
Hey Soc

Live in NJ as well as all other parties. Have joint custody. This past friday I went to pick my son up from school--I have a court order that I can pick him up from school, but b/c he has moved recently I don't do it everyday. I brought the proper paperwork to the school

They called to check with mother first and she said don't send child, call the police-which they did. Police told me that I could not take the child and would have to wait till 6:00 for drop off (which is our usual drop off time on my weekends)(but I also have right to pick up from school)

After mother had police escort me out of school she then refused to drop him off for my weekend.

I have written before about her throwing out my cell phone and not allowing any calls from me.

Question: What can I do? Will they just give her a slap on the wrist for this behavior if I take her to court?

Dear Socrateaser / health care professional

Hey Soc

I lIve in Nj -joint custody of 10 year old. It never ends with my ex-wife. afeter defending myself against unfounded child abuse charges and a slew of other falsehoods. I get a call from a "mental health expert" that she has taken my son to. The expert has asked will I sit with her and husband because of some concerns about my son(probably that I have supposedly done). I have no desire to sit across a desk from the 2 people who constantly seek to destroy my relstionshsip with my son. She will pretend to be doing what is best for our son and then go home and make derogatory phone calls to me. I've been dealing with her for 11 years now-nothing ever changes this is to get something to use as levergae against me at court because she knows I will be seeking custody because of her latest antics.I have told health care professional I will meet with him alone but would prefer not to meet with the 2 of them-unless court appointed

Question--Will it look bad if I refuse to go to this health care professional she has chosen and meet with her and her husband -can it be seen as being uncooperative and be used againsat me in court

She has been seeing this man for months now and has told her side of the story -I feel she has an unfair advantage

Salutations Soc

Live in NJ have joint custody of 10 year old.At the beginning of last month my ex and I went to court-agreed that my mother would pick up son from school to avoid afercare costs(and mother is retired and wanted to spend more time -However the lawyer agreed to this without judge signing anything-and said would send papers to judge to make this an order

Ex spoke with mother and they agreed that ex would call mother back with all information when she was ready to begin this arrangement

Weeks later I get a letter from ex's lawyer saying she wants money from aftercare to come through child support payments and it is too much of an incovience to go to mothers to pick child up and mother said this was a hassel (complete lie my mother was excited about picking up son and would love to do this).

So she enrolled him one month after agreeing not too-Now she wants money taken out of my check for it

Question** I want to go back to court andhave my mom picking him up made a court order-what do yo think my chances are now that she has already enrolled him in this afterschool program

I's $85 for 2 days-- when my mother would pick him up for nothing

Beleive me I know her intentions are to get the money and take him out as soon as the smoke clears-she's pulled this before

Dear Socrateaser / Visitation situtation
Feb 09, 2007, 10:00:36 AM
Hey Soc

I live in NJ -My ex-wife and I have a custody agreement and I get EOw visitation from Friday at 6 to Sunday at 7. She has always been remiss about this agreement but lately I have gotten tired of it

Two Fridays ago she was angry because I refused to agree to an increase in CS-so to get back at me she calls my mother (which is the drop-off spot) and begin shouting at her saying she would not bring him. My mother finally tired of her tirade and said she would not listen to anymore and hung up. I never received my son-

So Saturday I document it with police and then texted her"Where is he"--you are now 12 hours late for drop-off). She texted back my mother was rude so to prevent conflict she kept him-Dropped him off 4:00 p Saturday(she never goes into my moms house just leaves him outside and let's him ring the bell so my elderly mother was not a deterrent).

This past Friday-I texted her "Can you have him to my mothers by 7:00 (giving her a 1 hour buffer ) I had a basketball game I wanted to take him to. She then texted back she was having car trouble-so I texted back ok I'll have him picked up where is he--no response from her. He ended up being dropped on my sisters doorstep at 12 midnight that night  My son later told me they had no car trouble she was in the bed and didn't want to leave without boyfriend

I have little time with my son and even that is being shortened

My Question: Do you think these text messages are enough to prove she is habitually encroaching on my time.

Can this along with the fact she refuses to let him call and has thrown out my court ordered cellphone be enough to to seek custody or is this a long shot?

Dear Socrateaser

I am a father of a 10 year old son in NJ. Recently I have been served papers for a recalculation of child support. So of course I have to give all my financial information.

My current wife and I own a rental property (which I do receive some income from) .Can this be considered in the recalculation even though this is my current wife's property as well.

I get my son EOW--my ex wife has always been laxed-she will plan trips on my weekend or plan other activities. I have never taken her to court on this b/c I thought that eventually she would change (wrong). Drop off for my weekend is at 6 on friday night-- last 4 visits she has dropped off on saturday at 5:00,on Friday night at 12 midnight,Friday night at 11:30 and last weekend not at all she called saturdtay and said she was tired and was not coming-now I am keeping documentation (which I should have done all along). If I take her to court wih this what will happen--I mean she hasn't denied visitation she manages to drop him off just  a day late (besides the last visit which was not at all).

Father's Issues / Obtaining Custody
Mar 05, 2007, 10:02:32 AM
Are there any fathers on this board that have actually gained custody b/c of custodial interference from the other parent?
