Child Support Issues / Just curious

My husbands ex has 3 children with 3 fathers. She lost custody of them due to abuse/neglect and drug use. The BF of one child went to a child support hearing (BM didnt show up) and was awarded support. The child support office now says they are trying to locate BM to serve her. They have talked to her on the phone and her response was catch me if you can. My question is will they still garnesh wages for support since the judge has signed the orders? Do they just have to serve her the orders to give her notice and the opportunity for appeal? They had no problem serving her notice of the hearing because she wasnt expecting it but now she is playing hide and seek (and pissing off the attorney generals office). My husband has a court case filed now and she has an attorney on record for it. Can the attorney be served with the orders? We live in Texas.

Does anyone know how to calculate child support in texas? the NCP BM has 3 children with 3 fathers. 1 child lives with BM and other 2 live with custodial fathers. How will that be calculated?

We live in Texas and my husband CP has filed a motion to modify seeking supervised visits for BM. I get my information from my husband and I am a bit confused. He had to file a motion (not sure what it is called) because it had been less than a year since last hearing and a motion to transfer the case (because BC has lived with him over 6 months) and the motion to modify visitation. The BM was served in April the case was transferred in June. Now the attorney told  BF there is a 45 day wait and he has to give some time after serving BM with notice of hearing. If anyone knows about this please explain.

Is it 45 days from transfer before hearing can be scheduled or 45 days from transfer till hearing takes place?

I am the CP in Texas. The BM has now taken a job working weekend nights. Her visitation is every other weekend Fri at 6p to Sun at 6p. She isnt really going to see her child because of work and sleep time. I have custody of BD because BM has a drug problem and had her children removed for abuse/neglect. Due to her history I know what is comming with child care (every dope head in town). Can I seek modification based on her new work schedule?

I am the CP of BD and have been battling my ex since 2003. I finally got custody in 2005 and expected she would fly far away (with her boyfriends and drugs). Wrong she has insisted on her visits and her father picks up and delivers for her to make sure she gets them. I recently dropped a court case because my lawyer didnt feel I had enough for supervised visits (the lawyer is still paid for and ready to pounce). I scheduled a meeting with ex,myself,my wife, and a counselor and ex admitted to certain violations in our court orders. The counselor offered her some help but she refused and gave her some advice (dont bring men home when you have your kids). What does ex do? She meets a worker at the fair and drags him home last weekend when she had her kids,left her kids alone with him and he proceeded to spank the kids. She has lost her kids because of abuse and is ordered not to use physical punishment. I would like to know what to do in this case. She does have a drug problem also. She is good at doing just enough to look good. Keeps a job, has an apartment (one bedroom and drags men home), and a car (her Daddy keeps most of this going). Should I just move off or rely on the courts?

Seems my ex is back to her old tricks again. She insists on showing up for the two hour visits on Thursdays. I knew something was up because she parks on the street (down from my house) and stands at the end of the driveway while her eleven year old comes to the door. She has a drug problem so I figured she was back at it. I just found out it is beacause her car has so much crap in it there is no seat for my daughter to sit in and of course no seat belt. I drove to her apartment to check it out when I was told this and sure enough you would think she lives in it. NASTY!! My question is when Thursday gets here what is the best action to take. I really need to get it on video since we are currently in a court battle where I am seeking supervised visits. She is professing what a good mother she is.

I am the CF of my 7 year old daughter. We live in Texas. The BM has a drug problem and along with it comes abuse/neglect issues. BM has been on supervised visits in the past and I served her in April to modify to get her back on supervised visits. After mediation my attorney advised it would be best to wait on a hearing until she gets back on the drugs. By the time we got to mediation CPS had closed the case,she completed their safety plan, had two clean drug tests, got an apartment, etc. Since this is not the first go around with this and she is like closk work I anticipate she will be back to her old tricks by December. My concern is Texas has a mandatory 45 day wait until a hearing is scheduled and she always manages to get clean during that time but then go right back to it. Does anyone have advice on what I need to get a judge to see this isnt going to stop. What kind of evidence do I need? Since my lawyer is paid for it I am to call him when I am positive she is back on the drugs and living that life. I know I have to report things but I have to be careful because everytime she gets reported she learns a little more about the system and how to beat it. Has anyone else had this type of problem? What advice can you give me to help put an end to this?

I went to mediation last week (served BM with motion to modify seeking supervised visits). I took a big blow. A lot of evidence cant be used due to timing. Went to court last November but judge didnt sign orders until January therefore all of the abuse,CPS reports,safety plans, and safety plans cant be used against her. It is frustrating to be told even though you child got abused and neglected and it is proven you cant mention it. Now we have to vacate the hearing and give her another chance to abuse/neglect (and go through the horrible process of proving it). Life seems to work out for the drug addicted criminals. this isnt the first substantiated abuse/neglect or positive drug test.

I live in Texas and have served NC BM to go back to court for supervised visits. Since we havent been to court yet BM got 30 day visit this month. CPS closed investigation on BM last week and now she is nowhere to be found. While CPS was watching her she moved into her daddys and played the game. She has moved 4 times since last court hearing (Nov. 06), had 3 different men live with her, and yet another positive drug test. She is obviously getting back into the drug lifestyle and drugs (I have done this with her for 5 years she's like clockwork). I know I have a contempt for change of address but is there anything else I can do. I am concerned because of the type of men she associates with and what may be happening to my daughter. Why is it I have to follow every court order but she can do as she pleases and continuously put child in harms way and nothing seems to happen?

Father's Issues / Need advice or support

I have custody of my 7yo daughter after a long three year battle. I have had custody for almost two years now. The BM has had 3 more positive drug tests and several safety plans with CPS. I finally filed a motion to modify seeking supervised visits because of the things that have gone on during visits. The BM immediately moved in with her dad and finally passed a clean drug screen after being served. She was served in April and I am still waiting to go to court (due to Texas law on waiting and transferring the case to the county I reside in). This is the second time I have had to take her to court in this two years. CPS never does anything but put her on a sefety plan they cant enforce (and refuse to tell me what the plan is) and then close the case when she comes back clean. What are my chances of getting supervised visits? Does one negative drug test hurt me (for sup. visits)?
