Father's Issues / Harrasment
« on: Oct 25, 2008, 07:41:26 AM »
My STBX is harrasing me at my place of employment for support. There is no court order pertaining to custody of our child or ordering child support. I currently have physical custody of my child EOW for one week at a time, 2 weeks a month. I also pay for all childcare costs and the mortgage on our family home which she move out of earlier this year due to her affair and wanting to live near her new boyfriend and away from me. She works full time and has never asked me for anything, just went stright to my employer and started complaining. Now it is stressful and difficult for me at work as they are pressuring me to give her money. i have tried to hash out custody visitation through the court earlier this year, they assigned a GAL, interviewed, and nothin since. Court is next year. Any help would be appreciated.

Father's Issues / requirements during separation
« on: Aug 15, 2008, 06:24:43 AM »
I was wondering: If there is no court order in place, what are you required to pay for your STBX while awaiting a divorce hearing? Obviously I know you are required to continue to pay for anything related to your child but if the STBX works and lives on their own what are you required to continue to pay for them? Just wondering.

Father's Issues / Dr. Phil
« on: Jul 28, 2008, 06:44:10 AM »
Did anyone see Dr. Phil on friday? It had a family that had put a baby up for adoption without the consent of the father and due to some loophole they legally did it! They had the director for the National Institute for Men on talkig about how the government didn't care to find out if he wanted to care for the child but they will sure come after him for child support if the adoptive parents want it! Unbelievable!

Father's Issues / GAL
« on: Jul 15, 2008, 06:23:07 AM »
The court has assigned a GAL to determine temp. custody, any suggestions or past experiences with a GAL would be greatly appreciated. I know this shouldn't matter but the GAL is a woman, again I am a father seeking full custody of my daughter.

Father's Issues / STBX thinks she can tell me when I see my child.
« on: Jul 08, 2008, 01:19:40 PM »
Well, my stbx moved out last week and so far i have had our child one day out of eight. I have "asked" for her repeatedly but she believes that she can tell me when I am allowed to see her. I talked to my atty and they have filed the motion (see other post) which she and her atty objected to ( no surprise there). But he said legally all I can do is ask and voice my disagreement with her not "giving" me equal time with our daughter as if she has the right to make that call. Does anyone know what I could do? I still live in the marital home, pay all daycare costs etc. My atty says I can't call the police as there is no order in place specifying custody either way. I am her father and have been her primary cartaker for the last year while my STBX was consumed with her affair, she has no right to keep me from my daugter. I have tried to establish a schedule with her but she just blows it off and doesn't agree with me. I only want equal time with her. Help!

Father's Issues / Instanter motion for temporary custody
« on: Jun 30, 2008, 01:03:36 PM »
Filed the instanter motion for temporary custody and visitation today so we'll see what happens. I had to leave her with her mother today at her house even thought I didn't want to as who knows when I'll see her again, but hopefully this motion will work out and a schedule will be set and she will have to legally abide by it.

Father's Issues / Seperation and time with child
« on: Jun 25, 2008, 12:20:45 PM »
My STBX is moving out soon and doesn't think that splitting time with our child 50/50 is the "stable" thing to do, she thinks that I should only get 1 week a month and EOW! Remember we are not divorced and no agreement has been signed nor has there been any court order or ruling etc. granting her or myself custody. I am trying to work with her on an every other week schedule but she doesn't want to do that. So that being said, what am I to do in this situation. She has no more right to dictate where my child stays than I do. I would appreciate any advice or opinions anyone has.

Father's Issues / Alabama Joint physical custody.
« on: Jun 18, 2008, 12:43:12 PM »
My attorney says that he has never seen anyone get 50/50 joint physical custody in the county we live in in Alabama. I was wondering if anyone has experience with Joint physical Custody and why it seems like attorneys are so reluctant to encourage clients to do it. That is the only thing I am willing to agree to out of court, and if we both agree to it why wouldn't the court allow it?

Father's Issues / What Next!
« on: Jun 09, 2008, 06:10:49 AM »
So I caught my STBX with her BF again. Then STBX got laid off from her job for causing problems at work (directly related to her adultrous conduct) then I found a Rx for a STD in her possesion. How does all this play out in front of a judge? Remember this is  the third time I have caught her cheating. I only care about my child, I'll sell the house, etc.. Opinions please.

Father's Issues / Chances of getting full coustody
« on: May 06, 2008, 07:38:44 AM »
I am a 29 year old father and am in the process of divorcing my wife after I caught her having an affair. I was wondering what my chances of getting full custody of my 3 year old daughter are in the state of Alabama. I am active duty in the military and have been for the last 11 years. I am asking because outside of adultery I can't say that she is a badmother or anything like that, this last 6 months of divorce stuff has been hard on all of us, but she is a good mom. I was just wondering if being a male in the military in Alabama if I would even have a chance to get custody, my parents also live here and I make twice as much as my wife. I woould give up everything if I knew I could get custody, my only concern about it is dragging my daughter and myself through living tjis way until we go to court only for it to be a futile battle. I was just hoping maybe someone would have some advice and opinion or could share a similar experience and the results with me. --Thanks.
