Custody Issues / violating custody court order
« on: Dec 20, 2009, 03:31:02 PM »
I live in md, I have 50/50 joint custody. The child's mother is getting nasty and is starting to sway from teh court order. If the mother doesn't bring the child back at the scheduled time/date, what can I do. Can the police be called and a report filed? Or must it be pursued directly through the courts? I am also getting married this summer. The wedding is on a day that is my day to spend with my child. We each are entitled to spend one week of vacation in the summer with our child. I know she is going to try to do something shady to interfere with our wedding and I wanted to know what I can do to make sure she doesn't try to take him that day or use her vacation that week. Thanks for all the help. I can't believe how many times I have had to use this site for problems when The divorce order has only been in place since april

Custody Issues / modifying custody arrangements
« on: Sep 28, 2009, 04:49:56 PM »
I am currently in a situation where I have 50/50 custody with no child support. I feel like the arrangement is working well but it's been only 6 months since the court order and my ex already is trying to get me to change things informally by changing pickup and drop off places, trying to get him a couple of hours early, etc etc. She is threatening to take me back to court if I don't agree to change things. Am I better off trying to appease her and change things for her or should I just stand my ground now, knowing that she will try to take more and more by threatening to take me back to court. Are judges usually willing to change things all around even though we just agreed to everything just 6 months ago or will they leave things the way they are now. Any input would be greatly appreciated.

Child Support Issues / proving income
« on: Feb 01, 2009, 06:05:12 AM »
My ex is a hair stylist and is really lowballing her income. Does anyone know how to go about proving that she isn't claiming hardly any of her tips. She has actually told me how much she makes and I documented it but I'm sure this will not hold up in court. Also she only works 30 hours a week so will the judge figure support based on her 30 hour week or will they base it on a 40 hour week. If anyone has any idea on how to prove this please let me know.

Custody Issues / father fighting for custody
« on: Nov 08, 2008, 01:07:36 PM »
I separated from my ex over a year ago and have had a written agreement in place where I have had my son(3 yrs old) for 4 nights a week and my wife has him for three. Recently when my year waiting period was up I had my lawyer send her a letter asking that we go to mediation and work things out and keep the custody schedule. she replied quickly with a request for full custody. I have an extremely stable job as a teacher and will have off the same hours as my child when he starts school next year. Since this exchange we have both filed for full custody. I live in Md which is supposed to not have preference for either parent. She has also changed jobs and moved 3 times in the past year and is currently living with her b/f in a bad neighborhood and lying to me about where she lives(I can prove it). Is there any chance that I can obtain full physical custody and just give her visitation? What are the odds that she can take custody away from me? Who will be able to pick his school? Thanks for all your help. I look forward to hearing your replies
