Custody Issues / Do i need to file for a new order?
« on: Oct 12, 2012, 02:59:52 PM »
At my last hearing the Judge signed a order that stated
"The court further orders that unless further action is taken on this case, the temporary orders for sole legal and sole physical custody shall become permanent 90 days from todays date (Oct 15th)"
Do I need to write up a new order stating permanent sole? does the 15th count as  a date that it can be filed on?

I mean seriously?? Are there any books?? I can not figure out why someone would say f**** it; I don't need to see or talk to my kids. It's been nearly a year since physical contact and 2 months no phone calls.

Custody Issues / Update motion to set aside
« on: Jul 12, 2012, 06:53:09 PM »
So she told the judge how we mailed it to a address she told me via email it was wrong. Judge told her she should have updated her personal information with court the entry of order was mailed to a completely bad address. However I mention in my opposition to her motion she went to donnas house  she said some attorney gave her the order (oops on her part) so the judge said that she acknowledged she got the order so he kept talking and she stepped over him a lot he finally threw her in jail cuz of her warrant and scheduled a hearing this Tuesday

Any thoughts on how this will work out now.

How does this look to a judge? I'm just trying to get some weight to how a judge would look at something. With the motion to set aside she has coming up in a week (to erase her supervised visits) how does it look when she hasnt physically seen the kids since late November, and then 6 months later says "I shouldn't have supervised visits??

Custody Issues / Chances of winning motion to set aside
« on: Jun 06, 2012, 10:07:27 AM »
So my ex filed a motion to set aside the December order. 2 days before the cut off. Stating she was never physically served. My at the time attorney had mailed her the motion to two addresses and I emailed her the week of the hearing. She didn't show to court in December but the judge said the mailing and even my email sufficed and ruled for her to have supervised visits and me sole. She even went to Donnas House in mid January to sign up for visits and they told her since she waited more than 30 days to sign up she had to see our judge to get reinstated for visits yet she has waited til now to file and says I won let her see the kids and I ignore her emails. I do ignore the when can I see my kids emails cause she knew the court said supervised and I didn't want to fight with her.

Custody Issues / how long.....

can you go without seeing your children before there are some legal issues at hand? My ex still hasnt seen the children since December, I let her have a phone call once a week til she filed a petition (back in January) which is spoty at best. No motion filed and still all the warrants etc. if you are familiar with whats is going on.

General Issues / Should I just avoid the argument..............
« on: Mar 14, 2012, 07:55:21 PM »
So my ex who was on supervised visitation never signed up for her visitations in January. They told her She ahd to petition judge to get re-accepted. She emailed me asked for phone calls so she could talk to kids while she straightened it out.....back in mid January. She said they could be recorded. I agreed beleiving she would do something with the courts and said 5pm Wednesday 5 per child to start.
Fast forward today.....no motion or warrant issues resolved. But at 4:57pm I set up the recorder and placed a call. The recorder recorded that it went to voicemail after ringing 8 times. It also recorded the automated message stating all her 7 digits in her phone number. I have called her back previous weeks, to which she didnt answer and didnt want to have girls just sit around again while we waited again for more anxiety. So we tried and nothing.........
Check email at like 6:30 and at 5:05pm she sends me this
It is 5 minutes past 5, and I am waiting for the girls to call me still. Are you not allowing them to talk to me now? Please let me know why.
Im done arguing and already ordered the transcripts from the recording app. We tried calling...she let it ring and chose not to answer again. I honestly dont even feel like responding to this cause all I see is it is her trying to pick a fight.
Your thoughts?

Custody Issues / wow....speechless....
« on: Feb 13, 2012, 02:42:33 PM »
so my ex was placed on supervised visitation after missing her court date Dec 8th and issues with possible drug use and she has a warrant out for her arrest. Donnas House (the court supervised program) gives you 30 days to register for visits. Even though she didnt go to court she tried to pick up kids and i told her she was on supervised visits (3 days after court). She was dropped for not not registering for visits. She wanted a weekly phone call and said she was going to appeal to our judge to get back into program. I said ok. This was Jan 14th
We also had a child support hearing for her failure to pay support on Jan 26th. Did she show....Nope. Warrant issued through that court now as well.
Fast forward. So yesterday she sends me a email telling me about her baby shower and how the family wants our daughters to come to it in two weeks. She she invited the girls and....brace for it.....MY WIFE!! There is a long history of domestic violence between my ex and me and the ONLY interaction my wife had with my ex was when her and her now husband threatened me infront of our kids...which is from where the other warrant stems from. And she STILL has two warrants out for her!

General Issues / court results

We had court a couple of days ago. My ex is the one who owed 5gs back support, her ex testified about drug usage for my ex and new husband, and has a active warrant for her arrest out.
We had mailed out our motion to her last legal address and the last address I was aware of (due to a private investigator telling me) and my ex never filed a countermotion. The week of the hearing my attorney told me to email her and let her know we had court. I did. She responded.....said she had court in Jan for the same thing. i think she threw away the motion we filed cuz it wasnt just child support.
So she didnt show up....and now she is on supervised visits and I was awarded attorney fees and past support.

General Issues / Lawyer vs a pro see litigant
« on: Oct 20, 2011, 06:26:25 AM »
Thinking of maybe hiring a attorney. But it's really pricey. Do attorney's have more leverage in court? Can they not get in trouble for saying things you may. I have heard people say judges hate Pro Se litigants talking like attorneys cause they never went to law school.
