Going through a divorce and I signed an agreement with wife that sates I will only enter home when invited and leave when asked. She previously had a restraining order on me that courts threw out. State picked it up and soon dropped charges. Now that I have agreed to let her move back in home and am paying all bills she is acting very ugly. The prosecuting attorney that was assigned to domestic violence case was fired from this area for some reason and now he and my wife have developed a relationship. crazy...huh. I went in home after I signed agreement, which has not been filed in court and got some personel effects. She tried telling me that I could not, but I did any way. She called police and they waited till I left. My question is did I violate any laws. Is there any way she use this against me to get another OFP.

Visitation Issues / Visitaton

O.k., wife left and file O.F.P. and then the state picked it up and charged me with D.V..Civil court threw our O.F.P. and finally criminal court dismissed case. Both courts said insufficient evidence, because there was no act of domestic violence. Wife filed for divorce and refuses to speak to me concerning our 2 children. The oldest, our daughter does not want to be with her mom. They have a very volatile relationship. I have not spent time with kids in over 3 months. My attorney has filed a motion for visitation and support but says it could 2 or 3 months before we get in front of a judge. In the mean time I am thinking of going to get our kids. There is no legal confounds preventing me from doing so. I haven't because I do not want to upset wife any more than she already is. The problem is she lets kids spend weekends at friends and they go everywhere but to spend time with me, their father. What do you say about me forcing a time sharing schedule, knowing what her reaction is going to be.

Wife has accused me of domestic violence. She was coming after me and I went in house and tried to close the door. She tried to force her way in as I was holding the door. Her story is I repeatedly slammed her in the door. There are photos of bruising. But I did not slam her in door, I only held door so she could not get in. She filled out OFP and it was thrown out in civil court. Judge stated no act of D.V. State picked up case and she is going for my throat. She took kids and has filed divorce. Won't let me have any contact with kids. My question is what can my attorney do to get this thrown out of criminal court before it goes to trial. I did not do what I am accused of. This thing just won't go away. I am afraid if it drags out it will impact custody hearing. Please Help...If she was the aggressor by grabbing and pulling on me, isn't she the one that committed an act of D.V.

Custody Issues / visitation with kids

Wife left with kids 2 months ago. I am still in home. She and kids are living out of suitcases in a 4 bedroom home with 4 other people. Wife's attorney is demanding I move out of home and let them come back with me having no access to home or kids. If I do not she says she will file for an emergency custody hearing. She is saying that only through counseling i might be reconciled to kids. She is demanding money for support and counseling. I have not seen kids in 2 months and I have a No contact order with wife from courts due to pending domestic violence case. These are all lies. What do I do. I want to move out and let my family come home but I want to see my kids. I am scared that courts will not let me see kids. Wife is trying to make me look like a drunk abusive husband and father which is not true. Do I need an attorney. How can I show courts I am not what I am being accused of.

Father's Issues / false allegations

Wife left home and took kids. She accused me of Domestic Violence and put a OFP in place. Civil court said no evidence of D.V. Still have pending criminal. Wife says I'm an alcoholic and now after many weeks accusing me of being abusive father. I have not seen kids in 2 months. She wants me to leave home and have no access to kids or home. All these allegations are lies. There has been infidelity in our marriage but no abuse other than from her on me after affair. Should I leave home and let family move back. No divorce filing as of yet. Not sure if she is waiting to use that as trump card or if she does not want to file. We have not spoken for 2 months either. I have always been an active father and now i have been cast out of kids lives. I have attorney for criminal D.V. but no family attorney. She has hired a family attorney but I have spent all my money trying to stay out of jail.

Please Help
