My husband and I have the same problem with his daughter.  We get his daughter every other week and when child support was ordered we only have every other weekend visitation.  Now the order states we get her every other week, holiday and three weeks out of the summer.  We petitioned the courts asking the child support be decreased because we have the same amount of physical time as the mother and the judge falt out said no.  I don't know what their problems are.

Dear Socrateaser / Supervised Visitation

In the early part of 2006, ncp was issued supervised visitation, to take place at a center every Sat. from 11-1.  He hasn't shown up at the center since May 2006, I continued to come through July and talked to the director of the center and he told me that the attendance was being reported to the courts (I don't believe that though).  I am ready to take him back to court on the grounds that he hasn't followed the order and I am hoping to terminate all contact, he obviously doesn't have a interest anyway.

1) on my paperwork what should I ask the courts to grant?

2) is it likely for a court to terminate all contact?

3) if i take him back to court on grounds of not showing do you think they'll issue something basically saying show up?

4) should i leave it be for however long?

Not be sound like an idiot but if he is going to school full time how is he to pay child support.  We aren't married but I am supporting him 100% while he is in school.

1) How can the courts order him to pay what he technically doesn't have?

2) He already has her every other week so will going to school full time effect that?

I don't know if I have the legal rights or not, my lawyer said that is how we are going to handle it and if he wants visitation he'll have to take me back to court.  The supervised center said they are reporting the absences to the courts and it's up to me to continue to come.  I am not held by the courts to take her there, my lawyer spoke without instead of letting the judge rule/decide on the matter and they agreed to supervised...

Dear Socrateaser / Child support

My boyfriend is currently paying 375 a month in child support, in the state of Maryland even though he has his daughter every other week and is responsible for all expenses incurred during that time.  In January he will be a full time student and his age is 25.

1) If you are a full time student do you still have to pay child support?

My daughters fathers has now missed the last three supervised visitations.  I was told to send him a certified letter telling him since he has missed the visits that I am now terminating them.  I need help in writing the letter though.

1) Can you give me some verbage or ideas to put in the letter?

2) Is there anything that the letter must state?

Thanks

I am the child's primary custodian.  I have sole legal and physical custody...

I want to go back to court to stop the supervised.  He got supervised as a result of a abuse against the child.  I would prefer no contact at all.  Plus when he does show he up makes all kinds of promises to the child that he never keeps and I'm constantly consoling a confused and hurt five year old child.

My case is in Prince Georges County Maryland and this past weekend the other parent did not show for his supervised visitation...  We have had supervised for about 5 months now and this is the first time he hasn't showed.

1) Can I go back to court after one missed visit?

2) Should I continue to show up to see if he comes?

Dear Socrateaser / RE: Court on yesterday

The DA's office here is so slow.  I have been calling and leaving messages daily for three weeks.  I'll continue to call them and him seeing her is not allowing me to sleep.  I may have to ask my lawyer to take it back to court before the 10th of this month, when the supervised is supposed to start.  Thanks for all of your help!
