Back in Feb 06-My ex quit his job as a LVN before we went to court hearing for CS, I found out he had orientation the following week and stated it to my lawyer, who in turn asked him under oath if he had a job lined up, which THANK GOD, he answered truthfully and CS was made for HRLY rate, not his whole income, which you know as LVN in TEXAS you count mandatory OT. Anyways, AOG office never changed his Order to new Job, even though I sent FAX with new address. This has been since Feb 17th 2006. He is making voluntary sporadic CS payments, less than ordered amount and for March & May $0.00 dollars. I just found out on 6/8 that they had wrong employer and corrected it they faxed order on 6/9, he put in his 2 weeks notice to current employer 6/10. I do not know where he is going.... WHAT CAN I DO?

Guess what, God does answer prayers, Father (Church) just called and he will have my baby do her 1st communion with the 4, 5, 6th graders the following weekend the 25th Sun and her confession on June 1st. WOW!

thanks to you I did not do something I would have regretted I have never broken the law and do not plan to start now and give my ex any ammo against me.

There is no other time for her to do her 1st communion, I cannot just change it she is not the only one, she has been attending services and  preparation classes since she was 5. What is my recourse?

My divorce is final, I live in Texas, my kids and my ex live in Texas. I have a 9yr old and 4 yr old. My daughter (9) has her 1st Communion on Sat 17 of June, but it is father's day weekend, father refuses to cooperate and have her attend cermony.

1. What can I do in a legal aspect? Divorce Decree states father's day weekend with dad.

2. Can I mail a letter of intent? How do I word it? Such as I cordially invite you and yours to bla, bla, bla, and state that my daughter will be available to him by Sat night after ceremony.

3. What can be done to me if I do not provide her friday at 6pm?

He will not cooperate and will not answer my calls.

Too funny,
1.) You all are right who would want to be close to my case NCP, I do not even frequent that side of town let alone a pool.

2.) She may feel threatened, or insecure and does not want to be remined of NCP constantly.

3.) An occasional visit no-prob say 1 a month, but still not clear on the times he goes over is it constantly?

4.) I commend him for wanting to spend time with his daughter, I wish my ex would call kids more often. (that's why I purchased cell phone just for them)

I guess the THREAT of going back to court and filing for 1/2 of daycare expenses did the trick, and revolking some visitations.

He called Thursday and said he would pick up kids on Friday 7/7, which he did. He enrolled them in daycare. I am on the emergency contact list.

I do not know if i was right in making an issue of this but here is what I did, for ya'lls dissection.

My daughter wanted to take her gameboy/ 1 game, baby pillow & Blanket, (I asked her to take her cell phone), and my son took his Elmo which he sleeps with.

I made a note and requested NCP to sign it. He refused, I told my daughter she could not take those items with her. ON the note it states he is to replace/return said items by August 1.

Now he made an issue that it states that in the court order, and I said yes it does, I just want to reiterate.

He said why, I said cuz you took toys, L.girlfriend lost them at the park, and you did not replace the items and have not returned the items, Also you keep clothes and I have had to resort to PD helping me in collecting.
Even though as you say it is on the court order which you seem to ignore to your convienence.

And these items are expensive or priceless. Gameboy & Baby items.

My daughter made a big enough fuss (putting it lightly) so he went ahead and signed.

Was I wrong? He said he purchased lost items from the Park, I said where are they, he said "in my home" I said you did not purchase said items what makes you think you can keep them. Replace the things kids took from my home, return them to my home, and purchase some for your own house. Dont take from mine, from the little money I have that I provide for the kids you take, take, and take.

He just hung up, lets see if he returns all the items come Aug 1st.

Sounds good, I did not have the daycare costs included in my child support.
Money unfortunately is an issue right now, that I am not making ends meet.

I am not saying I would do that, I am saying WHAT would it help my kids or me (in court) to do that, had you ever had that happen? I know what my kids want... my daughter said "I had prayed to GOD for us not to go to dad's for the whole month" then she smiled.  I know where my kids want to be with me. I am just saying IF I make the report HOW can it help me in Court?

I would not MAKE them go with dad by force just make the report and keep it for when I went back to court, and request daycare and expenses reimbursement.

It is not inconvienent as you say, I am TIRED of HIM not being the RESPONSIBLE parent he should be and the courts allowing him this behavior, when ultimately it is my kids who are hurt and feel unwanted. They had their bags packed and were all geared up to go (I kept a positive send-off atmosphere for them) then he BOOM doesn't show! ARGGHHH!

On another note: I have an audit due by the 19th of July I was going to be working late, really I HAVE to work late, which I hardly do when kids are with me I mean Late by 9:30 pm to 10:00 pm, usually I work until 6 or 7 latest. Now due to this really wont matter, kids will not see me or him.

Will I upkeep his everyother weekend? NO! I had plans with my kids since I was getting them 2 consecutive weekends.  On the 15th & 16th I got free tickets to seaworld thru work, and I had won a 3 day 2 night SPI condo at a conference last year that I booked for the 22nd & 23rd with free Schiltterbahn tickets from work. Now these plans are set in I will not change them for him.

Why 1/2 of Nanny fee, shouldn't it be 100%?

Sherriff said if he picks up anytime during month then I can call them when he drops off and state he is child abandonment. True? Has this happened to you all before?

No my hour vary I only pay her 100.00 a week and daycare is more expensive for two kids.
