What step of the custody & divoce are you in? It really depends on who hears your case and what state you live in.

If the police came, did they make a report? Any time she physically beats you, you need to call 911 and don't take that lightly, unless you want her to spend a night in jail....sometimes that will wake a person up though. Filing a PPO will be much easier if any violent events have been documented. Print all emails and IMs from her and put them in a 3 ring binder, oldest in front to new, in chronological order. It is easier to get a temporary PPO against both parties as that won't identify an abuser if its a no-fault case.


If she's using and you have proof, you have a good case; demand random drug testing and offer them yourself as you shold have nothign to hide. You will need to be able to show that yoare currently the primary care giver as most judges dont' like to uproot kids; be as active as you can with thier school and activities; you will have to show that you are the "better" parent according to federal and state custody guidelines; you should be able to find them online by doing a search and get the ist from the federal website and the state and county webite. should you have to leave the marital home, take the kids with you as it sounds like you are stil living w/ her??? That will be an obstacle if you are trying to get a PPO, but I would recommend one if either one of you are hostile against each other.

You will have to show financial responsibilty and have a plan setforth fo child care/ day care/ latchkey and request she be obligated to pay a certain portion based on federal/state guidelines. If she's not working, income should be inputted on the minimum income threshold.

Get a temporaty custody order in place ASAP; should she get visitation, and you suspect she's using, call 911 and tell them you suspect she's under the influence. You should not release your child(ren) to anyone who's under the influence as that puts them in danger.

If you know she is going to  someone at your place of employment, whether it be email, calling, writing or going there in person, first aplogize (even though it is not your fault) and you do not need to go any further other than writing either your manager/officer or HR dept. that your ex is a major inconvenience to you and she has no proof of points of being there other than harass you; your employer should kindly let her know she is disturbing the peace and conflicting in a professional environment and they ask her to leave; if she refuses, a call needs to be put into law enforcement, whther it be local police or the base's MP.  She is just trying to pull our leg and embarass you.

Your employer shouldn't be discussing anything to her as you are the employee, unless you've authorized them (IN WRITING) to discuss personal issue with her about your employment. Have your atty. file a temporary restraining order against her, hopefully it can be issued until she cools down.

There should be a medical support enforcement dept. that handles your case. at the county/parish in which your case is handled. Most forms can be found on the web via internet on the county's/parishes' website. Most states only will enforce medical expenses that are under a year old and if all the yearly costs exceed a certain amount of oney. Where I live, it's $289.00 per child per calendar year.

In most cases if there is an order regarding medical reimbursement, you have to notify other party, give them "adequate time to pay or respond", and if they refuse to pay or try to settle on an amount that is below what the court states, then file a form with the court; the court will then send a request to the other party and CC on you and also make sure you've requested payment befre contacting them the other party then has 30 days or so to respond and if theyrefuse or don't respond, a hearing will be scheduled with a med. suport enforcement officer; be sure that if you go te route of making a complaint to enforce reimbursement, that you also attach all copies of receipts paid by you as well as the insurance explanation of benefits.  If and when you go to court, make sure you also take those receipts and EOBs with you.

In most cases, the other party will either pay on the spot or the expenses he/she onligated to pay will be tacked on the garnished child support, say and additional $20-$50 bucks per week until the medical reimbursement is paid in full.
