Child Support Issues / Pregnant child?

It seems that my 14 year old child is pregnant.

I am obligated to provide insuance and cover 1/2 of any uncovered medical expence.

My X  along with the parents of the boy have been acomplises in what I consider the statutory rape of my daughter by condoning and permitting her relationship with a 17YO boy by way of permitting him to stay at her home, allowing my child to go to his home etc etc etc. All of this against my urging to not permitt this relationship.

I will be contacting the cops with regards to this boy. My daughter may hate me for it but I think that will pass.

Do I have an argument that my X by her actions is solely responcible for the upcoming uncovered medical expensenes? Then what about my minor daughters child, who is responcible for this child.

What recourse do we have if CP refuses to sign IRS form#8332?

Decree says I get the deduction on odd years if support is current as of 12/15 of said odd year. In the past there where some small arears on 12/15 so this issue has not been raised before.

This year support is and will be current on 12/15 but I am almost sure CP will not sign the form.

The situation is as follows:

I have zero debt I dont owe anybody any money what so ever I own my home .

I have ZERO child support arearage.

I have had my earned paycheck garnished each and every payday for 12 years this garnishment took place dispite me having one of the two children involved.

I have NEVER EVER missed any Parenting time. I have been the CP  of one of the two children for this entire time, he is now on his own and serving in Iraq!

I have a job that makes me misserable!

My 43YO X-wife and the one who gets the free money that is taken from me goes to "school" as she has for the last 5 years and as a result of her own CHOICE has an income of about $700/mo (of course not counting the $700/mo or so in free money she gets from me)

My wife supports whats I want to do!

What I want to do is make a CHOICE and stop working at my current job and do a job I want to do, at a MUCH lower income. It would mean some sacrifice when it comes to money but my mental health would be greatly improved!

Sound ideal dosent it?

As an American I should be permitted to make that choice as my X-Wife is!

However.

My Goverment says that I can do it as long as the money is there for them to take from me and give to another adult American at the same rate they do now without any reduction!

This is just not feasable so i must stay working and earning at the same level I am now or face punishment at the hands of my Goverment! IE: Fines, Driver licence suspension and of course JAIL!

I call this govermental bondage!!! What say you?

How the hell have we permitted this to happen?

"I dont mind paying support" Why do I read this statement so much?

I am not afraid to say it, I dispise sending one red sent of "child support" to my PBFH of an X. I hate it with a passion.

I hate the fact that my goverment takes my money and gives it to another adult without one iota of accountability.

I hate that my money gets taken from me and given to another adult under the guise that is is for my child. When I know damn well that these funds DO NOT go %100 to my Daughter.

Its not fucking rocket science to do the math and see the results.

Everytime I buy my girl a new pair of shoes, a new bra,new socks, a brush, deoderant, school supply ETC ETC ETC because she needs them. Even know that "CHILD SUPPORT" is taken from me each and EVERY pay check.

Is it some sort of guilt thing that some feel they have to say "I dont mind paying support" ?

Well DAMIT I do mind paying "child support" every dime of it. Its slavery I tell you, SLAVERY!

Child Support Issues / Will the IRS keep it?

Does anyone know how to find out if the IRS will keep any refund? In November the NH CSEA said I owed over $5K in areares and reported it to the IRS. I disproved this rather easy with the state and have the state audit to prove it.

After the NH CSEA cleared things up, they said that they would let the FEDS know and I should be OK. Well I of course dont trust them. Before I file and let them keep any refund I may have coming (how ever small it will be) I need to find out if the IRS is planning on intercepting any refund associaed with my SS#.

So can someone point me in the right direction? I am thinking I should just be able to pick up the phone and call the IRS and ask.

Child Support Issues / Property TAX idea

Brief history had split custady for the last 6 years son with me Daughter with her. Be paying her about $300/mo. Son is now a 19YO HS grad, in the reserves, has a full time job and taking a few classes. X has filed for a CS MOD acording to NH guidelines my CS will go up by about %300.

I am going to ask the court to deduct my yearly property amount from my income that he looks at for my CS obligation. It is quite outragious $4900/year =$95/week thats aprox %10 of gross pay. The way I see it, no the way it is is this is NOT a volintary expence/debt and should be treeted the same as income tax.If the tax is not paid then the home goes away ! FYI my daughter does have her own room with all that one would expect to find in a 10 year olds room and this space must be maintained and does not go away when my girl goes back to her mom. Anyone ever hear of this or try this if so did it work? It makes perfect since to me!

Any other thoughts on how to stop this giant CS increase?

So here it is,
EX and I have 2 kids. We had split custady son with me daughter(now 10 years old) with her for last 6 years, now my son is 19 a HS grad, full time job and in the reserves. Got served papers for CS mod because son is now an "adult". Acording to NH guidline(for 1 child) EX will be getting almost a %300 increase in CS. I have always paid her CS $300/MO dispite having SC. Anyone have any ideas how I can prevent this? This increase will brake me!

Hope all is well with you and yours!

I have a question about weather the benifecery on a life insurance policy should be the estate or a person . Currently its the estate and there is a will that dictates where the money should go. IE: the Kids, Wife , Dog etc.

1. If the Wife was made the benifecery would this protect the life insurance money from any crediters I may have or could the crediters still come after that money?

State is NH.

Hello Soc;

Hope all is well with you and yours.

I am in NH.

A few years before I bought my home and property one of the abutters planted several white pine and spruce trees along the property line. Fast forward a few years and now these trees are growing very fast and the lower limbs are invading my space.

I am curious so I find the actual property marker pins and run a line between them and it turns out that most of these trees are auctualy planted smack-dab on the line or on my side. The trunks of the trees planted right on the line are auctualy also growing onto my side.

The trees are becoming a problem for me and robbing my gardens and lawn of sun light and this will increase as the years past. I dont want the trees there. Me and this neighbor are not really friends.

1. The way I see it the trees and any part of the trees on my side of the line are mine and I am within my rights to cut them down as I see fit. Do you agree?

2. Would you just cut away and let the neighbor react or advise him of you intent first?

3. If I cut the trees the trees that he in fact planted on my side would he have any recourse against me?

Final degree gives tax deduction in alternate years to each Parent. CP refuses to sign the required IRS form so the NCP can claim the child.

1. Would you sue in Family court for contemp or small claims for the amount of tax refund that the NCP lost due to CP refusual to sign?

I am under a CO to pay my X $1950.00. I have untill 10/6/05 to make good on this order. I will only be able to pay $1200 by that date. I will need about another 2.5 - 3 months to pay the rest.

1. Should I  just pay what I can when I can and wait for the other side to react?

2. Should I write the other side explaing my situation and ask her to cut me some slack on the time?

3. Should I file a motion for an extension of time on the CO?

4. If 3 is afirmative what would it look like?

5. With the fact that I will have %63 of the total CO paid in time could any judge find me in contempt?

I reside in NH, I actully work in VT, my company is based in PA. I have been with this company for 8 years. My company needs me to go to a 10 day service school that will benifit my company as well myself .

They want/require me to sign a training agreement that contains the following paragraphs.

13.   The direct cost of this training is being paid entirely by ******.  Due to the significant investment being made by ****** at this time, the technician agrees that should he/she leave our employment for any reason other than termination or lay-off initiated by ****** within one (1) year of the date of completion of this training, the technician will reimburse ****** for the full cost of the training and associated expenses that were paid by ******.  The technician agrees to permit ****** to withhold this reimbursement from any unpaid wages, vacation pay or un-reimbursed expenses due the technician at the time of his/her departure.               YES/NO   
 
14.   If the individual requesting training does not complete the one (1) year employment rule, the full cost of the training and associated expenses will be required to be paid in full and will not be pro-rated.

15.By placing your signature below, the individual receiving training has read and understands all of the above.

1. Is this a legaly binding contract?

2.Would it be enforcable?

3. Can a company withhold ones pay for the above reasons or for any reason?

4.Do these words "for the full cost of the training and associated expenses that were paid by"  include the pay I recieve while at this school?

5. Would you sign a contract that contained this wording.

State in NH.

If you will please give me some ideas on how to capitalize on my opponents dishonesty and her misleading of the court. This is a very confusing and convoluted matter so I will try to give you the facts and a brief history. I have posted on this issue before.

Final decrees says the marital home will be foreclosed on and both parties shall be equally responsible for any deficiency. The home was sold for a loss at auction the bank wrote off the loss and the deficiency became $0. However the IRS attached the $43K loss as income only to my EX and taxed her on it.

Years later (spring 04) the EX filed a motion to compel me to pay her ½ of her taxes,penelies and interest that she "paid" the IRS. I objected to this on the grounds that the deficiency was zero therefore I owe her nothing. Basically her taxes where hers and hers alone.

Well I lost that argument and was ordered to pay some $7K – $8K within 90 days. I was only ordered to pay the actual tax assessed no interest and no penalty.  I filed a motion to reconsider that was denied.

August 04 I filed a motion to modify to give me 6 years to pay. I also filed a motion to clarify because the dollar amounts on the courts order and the evidence that my EX submitted did not add up. The EX objected and asked the court to order me to pay her legal expenses as result of my frivolous motions.

 As a result of this motion the court responded in part with the following "The court is concerned about the accuracy of the amount paid by Ms. ***** to the IRS and cited in the courts order. The courts order was based on Ms. **** representation that she incurred a liability with the IRS which she paid. Ms. ***** is therefore ordered to file an affidavit under oath with supporting IRS documentation establishing the amount she paid the IRS. Assuming her representations at hearing as to the above matters are accurate, her request for cost will be granted".

She filed this affidavit reaffirming the numbers she first gave to the court. Months passed and I heard nothing from the court. I asked you about this delay and I called the clerk she did not have an answer for me but said she will get back to me. I never heard anything from her or the other side until I filed to change my summertime "visit".

Along with her objection to my motion she filed another affidavit on the same issue as she did back in Aug,04 however this one has totally different number than the first one.

She seems to "come clean" about a $5200 refund she got from the IRS in 03 with regards to this issue she claims that she "did not know what this money was for and did not associate it with the issue before the court.

She also seems to come clean about a earned income credit of $1200she received during this time frame and had to pay back. This $1200 was also included in the amount she wanted me to pay and included in her first affidavit.

I know its confusing for me and its my thing. I hope I have made the situation clear for you.

To sum it up as I see it. She filed a motion to make me pay her a specific $$$ amount she won that motion. When called on her numbers she filed a ironous and misleading affidavit. For whatever reason there was a 8 month delay in the process. Now she files another affidavit on the same issue claming she made a "mistake" with her numbers.

I believe she was trying to bilk me for money and lied to the court both verbally and in writing and I want to capitalize on her deceitfulness to the court. She knew she got the $5200 and she knew she got the $1200 and tried to hide these monies from the court and myself.

We will be before the court on this matter in June.

1.   Any ideas on how best for me to approach this and use it to my advantage?

2.   Based on these facts how can I get the court to vacate its original order and find that I don't owe her a dime?

In a upcoming hearing for a change in summer "visitation" the other side has filed a motion to have a GAL apointed and that I pay for it in full (suprise, suprise). Of course I dont agree with this at all.

I plan to object to the apointment all together on the basis that I am not asking for anything out of the ordinary (4 weeks during the Summer). I realy dont see the need. Our Father/ Daughter relationship is well established.

The Mom has asked me to take our daughter for more time during the summer when she had child care issues etc.


1. Is it wise to object to the apointment or should I just object to paying for it?

My divorce decree gives me 2 weeks of time with me Daughter during the summer I want more like 1/2 the summer 5 weeks. My Daughter is going on 12. The 2 weeks has been in place since 97. I sent me X a proposed agreement and she rejects it and says "the way it is is the way it will stay".

I have a very strong relationship with my Daughter never ever missed a "visitation". Damn near every summer my Daughter ends up spending more than the 2 weeks with me. This happens when the X has some sort of conflict no sitter etc (when its convient for her). I never turn down "extra" time.

I proposed a formal agreement so I did not have to depend on the whims of my X. When I sopke to her about it she refered me to her atturney I called him this AM and he just flat out says "we reject it" wont say why or offer a counter offer of any type.

The relivent facts as I see them are My strong and consistant relationship with my Daughter, My X asking me to take more weeks in the summer with my daughter over the years, my daughter relationship with her 1/2 sibling and step siblings, my daughter desire for more time

1. Do I file a motion to modify the permanant stips or a petition for more time?

2.Do you agree with the relivent facts as I see them?

3. Would/Could you use the Xs unwillingnes to cooperate against her?

In July,04 I filed a motion to modify and a motion to clerify. These motions where filed in response to an order for me to pay my X some monies associated with a tax debt she incurred as a result of the forcloser of the marital home in 97.

As a matter of course the the X objected to both of these motions.

The court did/has not made an "final" order with regards to these motions however the court did order the following on August 8 , 04:

"While the respondent objects, the court is concerned about the accuracy of the amount paid by Ms. ***** to the IRS and cited in the courts order of July 28.2004 as $9282.00. The courts order was based on MS. ***** representation the she had incurred a liability with the IRS which she had paid."

"MS. ***** is therfore ordered to to file an affidavit under oath with supporting IRS documentation establishing the amount assessed to MS. ***** by the IRS in 1997 from the deficiency forgiven by mortage corp and the actual amount pais by MS.***** to the IRS within 14 days of this order."

My X filed this affidavit within the 14 days along with IRS documentation clerely showing that she did not pay the full amount of what she represented to the court. Her actual (assessed tax) amount was about $3500 less than what she had represented.

This was the last I heard from the court or my X about this issue. I have not paid her anything with regards to this issue. I expected some sort of "final" order on this. Now its some 8 months later and nothing. FYI I have not moved,relocated or changed my number. I pick up my child EOW from X so there has been some contact.

1. Should I call the court and inquire about the status of this issue?

2. Should I say something to the X about this?

3. Should I just let sleeping dogs lie and wait?

4. Should I expect a rude awakening form the court if I dont call them?

I know this my be an odd question but I want to stay in bounds with regards to all the forms I may have to fill out. Furthermore I want to be able keep certain things and I dont want the trustie to be able to take stuff the they have no right to.

1. From a legal (bankruptcy) standpoint if I have a motorcyle but this motorcyle is in pieces and parts in a number of boxes do I have a motorcycle or a bunch of parts in boxes?

I have an issue with a minor child (17 YO) running up the phone bill. This has been an issue that has driven me to put a block on my line so that one has to enter a code for long distance. I put this block on a few weeks ago with my long distance company.

My 17 YO  found a way around it by using one of these 10-10-220 companies now they have billed me $150. I called them and went right up the chain of command and did not get a good answer.

They refuse to remove the charges. My argument with them is that I did not suscribe to or invite there company into my home a minor child did.As a matter of fact I took measures to prevent this. Therfore they should eat the charges.

1. Do I have any legal grounds to just refuse to pay them?

2.In the absence of an agreement from me (IE: I subscribed to there service) do they have the legal right to put this "debt" on my credit report?

I was "shopping" for an attorney for my pending matters. I must have spoken to 10 - 15 right from the phone book. Most listened with some interest and most advised me that it would not be cost effective. All took my name a few took my adress and said they would get back to me.

One attorney showed some interest took my name and adress and told me he would have to speak to his partner and get back to me. He called me back a few days later and had the same answer, it would not be cost effective. OK thats fine

Fast forward a few weeks and guess what I get in the mail? A bill from this guy for services rendered $80 unreal! I never agreed to pay him nor did he imply or tell me I would be billed. Fees never came up. Out of all the attorneys I spoke with none but him sent a bill.

1. How should I respond to this bill if at all?

2. Did I some how unknowingly enter into a agreement with this guy?

I am thinking about making an offer to settle the case with my X as it stands now I am ordered to pay her about 7.5K within 90 days. However I have faith the Judge will reduce this to about 5K based on a motion to clarify and I hope give me 6 years to pay based on a motion to modify. Both of which are pending.

I am going argue that 90 days is unresonabl as it is %110 of my net pay for that time frame and that I just dont have the cash flow to do this. Afterall numbers don't lie do they? I do have acess to  $3K on a CC
 
 I want to make a lump sum offer of $3K to make this go away.


1. Can this offer be used against me in court? IE: Well your Honor he offered me $3K last week now he claims he does not have the$$$

2. Wuld you take my offer of $3K NOW or $5K over 6 years knowing that I am on the verge of BR?

I am on the verge of filing for bankruptcy not sure yet if 7 or 13. Soon before the 9 of October as I am getting married and dont want to include her in this.

I have a credit card jointly with my mother (she is the primary card holder)since 1995 and the balence had been 0 for 2 years or so.A few month ago they offered a deal with these checks of 3.99% for the life of the balence not a bad deal i thought.

So I transfered $8K to this card from other cards of mine using these checks, with a plan to pay it off in 4 years @ 3.99%. Well, best laid plan fall apart. Now I NEED to file however I cannot "screw" my Mother.

So I need to get her off of this card or somthing I have filled out the forms to remove her from this card and we have both signed them. However I dont think the CC company will remove her.

So I have a plan to efectivly reverse the balence transfer back to the original cards. It will be about $2000 per card on 4 cards. I know that doing this mybe looked down upon by the trustee.

I have been told (wink wink) by a attorney that since it's a small amout on each card the individual card companys may not contest it, even know it was so close to me filing.

I do have apointments to talk to 2 more attorneys

1.What do you think about this plan to protect good ole Mom?

2.Could tranfering this debt so close to filing for BR be construed as fraud or is it fraud?

3. If the card companies dont say or contest any of this will the judge let it slide though?

I am in NH and this is the state that my case is in.

I was out of the house in 94. My divorce was "final" in 97.

My final divorce stipulation states "the marital home will be forclosed on  the parties will be equaly responsible for any deficencies as a result of this forclosure" The house was sold at auction at a loss of $42K so the deficeny was that, $42K.

Sometime in 97 the bank forgave or wrote off the debt and the $42K became 0. However the IRS counted the $42K as income for my X and my X only. Why they did this I dont know. Needless to say my X had to pay tax on this $42K. With all fees,intrest and pealties about 10K.

My X took me to court for 1/2 of this. My arguemt was, that the  deficencies as a result of this forclosure was $0 since it was "forgave" by the bank and 1/2 of 0 is 0. Well the Judge did not agree and has ordered me to pay her.

Now I had no say in what the IRS did nor could I have said anything as my X and I filed seperate tax returns sinse 95. If the IRS would have attached my income for 1/2 of the  deficencies as a result of this forclosure ($21K) my tax burden would have only increased by $1500.

So in effect what this local superior court judge did was to  make me   responsible for another persons Federal income tax. I filed a motion to reconsider and he denied it with out even a hearing.

1. Given the info above does is sound like this Judge acted out of his juristiction?

2. If so do you have any ideas on how I can fight this court order?

My "final" stips from 97 gives me only 2 weeks in the summer I want to change that to 5 weeks or 1/2 the summer.

I tried to make an agreement with PBFH and she wont agree to anything. SAME OL SAME OL nothing new with her.

She just flat out refused to budge or discuss it and refered me to her lawrer. So I call him and get the same thing his words "we reject your offer".

So I will be filing a petition to modify.

I believe that it is "normal" for NCP to 1/2 the summer. Is this the case for the majority of you? Is there some stats I can point to?

My daughter is 11 soon to be 12 and has expressed a desire for more time. I dont think I would want her to go into court to say this. I just could not put that pressure on her.

I believe it is in the her best interest to have more time with me and her 1/2 / step siblings that live with me.

I have always had a strong relationship with my daughter and have NEVER missed a "visitation" as a matter of fact I hve had her for more than the 2 weeks for the last 7 summers always when it was to the benifit of the X. IE: she did not have a sitter ETC.

I have posted this with Soc he does not think that I have a strong case but I am still going ahead with this.

What do you guys think?

I am going to seek more parenting time with my 11 year old Daughter. I am going to propose a agreement with my X, but given her evilness she probley will not agree so we will be back in court.

Does anyone know where I can get a visitation agreement template that I can just plug in names and numbers?

Custody Issues / Right to know?

I am going to court in march for many reasons. I want to ask the judge to order my X to give me the full names of all of the unrelated adults that live in her house with my Daughter. I know there are two unrelated grown men that live in her house with my Daughter and my X refuses to give me this info. I have the right to this info. Correct? Has anyone ever heard of a judge ordering a CP not to alow unrelated adults to live in the home that the child lives in? These two persons cause me great consern, I dont know them, I cant find out any info on them . I also want info on the various sitters that she takes my Girl to, she wont give this info to me eaither!

Any thoughts??
