Child Support Issues / RE: As expected...
Jul 08, 2007, 09:01:33 AM
Make sure your son attendeds all hearings even if u are told that you dont have to show up. you control the csea there working on your behalf so find an alternative solution to make the ncp comply, see if you can find someone that is willing to hire her, and present it to the judge and ahve the judge order her to report to work or find out what other options are available, remember your goal is to get the necessary relief of child support. not to cause her to be unemployable due to countless arrests. it appears that the state and or county, city is exploiting this whole family there the only one making money from this

Child Support Issues / RE: FOC audit questions
Jul 04, 2007, 06:05:15 PM
What is FOC? who conducted this audit of your case? did you request this audit and how? what state?

In my state if an over payment was made the agency would be responsible for paying you back. not the person who recieved it. it would be the agencies burden to recover an over payment

check the statue in your state

the osce will make the adjustment after covering any arrearage that might be due and return your over payment or credit you the overage. they might even contact you and ask how you want it applied.

I would not recommend letting them tell that you will just be done earlier because things may change and you might find yourself with custody or someone else may end up with custody and a new child support order

Truth be told, if she really wanted to live with you, and being 15, all she has to do is leave and come to you if things are bad with dad. actually at that age there isnt much the courts can do but, abide by her wishes and try to make sure that this change is not going to harm her in anyway. If she came to visit you and didnt return, you couldnt physically make her return if she is determined not to go back, then the ball would be in dad's court and he would have to file court papers to try and get her back, which you would be served, and when you appear dont bring her with you and just tell the judge she doesnt want to live with dad, however if the daughter is ordered to appear then she will have the opportunity to tell the judge, lawyers and dad (he'll have to listen then) that she loves him but, would rather live with mom.
a judge will not force a 15 year old to live with a parent were the 15 does not want to live especially if the other parent is capable and willing to provide for the child, because by forcing a child at this age makes them a run away risk and no judge wants to be the cause of that.

Moms Without Custody / RE: New and needing help

Please not every woman can be a parent and we need to stop forcing these ideas on these mothers that leave, better to leave a child with there father than in a trash can!! maybe so many woman wouldnt just vanish if we would all stop being so brainwashed as to what society says is proper, they use to say a womans place is in the kitchen, barefoot and pregnant!! like the previous poster said...She probably did the child a favor. anyway there has to be a ruling as to why you were given supervised visitation and if the child acts like all is o.k. well, maybe because it is o.k. with the child. by the way do u pay child support?

I think you should find out why the teen is wanting to leave...at that age they can become defiant and not want to follow rules...ask dad why he thinks she wants to move, check how she's doing in school? and find out if he's been having any behavioral problems with her. Then maybe try letting her live with you on a temp. bases. by the way do you pay child support?

what is "OD"

I dont understand. do you love your husbands biological child? could you not fill that void (if there is one). seems like your hubby is doing a great job without your assistance and daughter is doing fine with a loving parent.

forget about the runaway mom, she probably did the child a favor. not every  woman is able to raise a child and when we force these ideas and guilt on these women to make them parents when there either not capable or just not wiiling to...we put the children in danger of harm even death as we see all to often on the news.

My understanding is that when the state of florida calculates arrearage they can only go back 2 years:

1. Is this correct?

2. if question number 1 is correct, then is it calculated two years back from the date the petition for child support was filed?

3. If so does anyone know the Florida statue concerning calculating arreages?

thank you....jen

Just sold house, title company is withholding a large amount to pay alledged childsupport, however the dept of revenue for child support enforcement
refuses to release records to title company.

title company baffled as to why child support enforcement refuses to release the file and say they have never encountered such resistance.

I have a petition before the court that was filed prior to sale of home which a judge would rule  on this alledged debt. after hearing the facts. I am the custodial parent of the minor children and have been for past six years and have not received any child support

unfortunitly a hearing date on this matter has not been set yet. I dont want any money to be released until a judge hears and makes a ruling on my petition, because if any of the money is released it would be extremely difficult if not impossible to recover money once in the hands of child support enforcement.

1. Could I file a motion to stop the release of these funds until this matter is heard before the court

2. or should I be seeking an order directing the title company to hold funds until further order from the court?

3. any idea how this should be written?

4. should the motion be filed as an emergency motion?

5. how should the motion be titled? (motion to stop release of funds)
(motion ordering the title company to continue to hold funds?) etc..?
