What about the ownership changing...sort of. the home belonged to both and husband has passed away and ownership was changed to reflect just wife. think that may make a difference?

           here's the story husband and wife retire and move to california..leaving a home in florida... husband let's grand childrens and there mother use home until kids graduate.

husband dies kids graduate a year later...wife settles probate and home is in wifes name ownly..wife asks mother to move cause grand kids are in college

it has been over a year and grand kids mother has made little effort to move

what would be the next step for wife to take to get grand kids mother out (she has lived rent free for about 10yrs and is raising another child who is not related as she is not related)

what should wife do?

           In my divorce I have the option of refinancing the marital home and buying out x-spouse. house is for sale at this time and i reside there with by bio-kids. most offers on home are extremly low and broker says the market is bad "nobody is buying" note: my state and county has been in the news due to corrupt realestate brokers, mortgage brokers, appraisers, state attornies and even the county property appraiser along with other local gov. officials are coming under investigation.
I am at a point were I can refinance the property.

1. question: how do i make a offer to buy out x.

2. how much info is needed to see if they are interested in the amount?

3. should i just send them and/or attorney a certified letter saying...." would you be willing to accept $xx,xxx as a buy out ?

4. how would you write a letter of buy out ?

5. what info should I include or exclude?

What state are u in?

anyway it seems to me that she has hung herself, they can argue it's not there fault that you may be asking for some crazy amount of support and you are the one not cooperating. how will the judge determine who is or who's not?   he or she probably would not be able to determine that, and it really doesnt matter beacuse the mere fact that she is not sending anything regardless of what you two could or could not agree on should piss the judge off and your attorney should really play that out strenthening your status as custodial parent. dont push the issue with her for support let it come back before the judge without her sending a dime for the children and sit back and watch her and her attorney get a good tongue lashing. and  have  your attorney prepared to ask for child support based on the states guideline plus arrears payable by income deduction.

I filed an emergency motion to enforce the court order and asked the court to order the banks to release accounts and not wait for the dept of revenue to complyalso I asked the court to order the dept. of revenue to reimbuse me for filing fees and other court costs...my accounts have since been released havent heard anything on the other requests for relief...

The dept. of revenue had there attorney at the hearing, the judges assisitant contacted the dept and was told that the accounts would be unfrozen immediately and the assistant faxed over a copy of the judges order to there attorney, I faxed a copy to the levy coordinator for the dept as well as a supervisor, also copies were faxed to the legal dept. of the banks holding my accounts. the state rep. also contacted the dept. of revenue. (I dont call or go there any longer due to the treatment I've recieved) unless I can have someone accompany me and they wont allow it in there interviewing rooms (interegation rooms).


I know we all would like to believe that this is just an error or incompetence, and believe me i have made all the rational excuses I could make, but the truth is that the excuses dont jive with reality.

I will send all my creditors a copy of the order and my efforts to resolve this problem.

A judge said it wasnt an emergency but, the case was heard by another judge who ordered the dept of revenue to unfreeze the accounts, how ever it has been about a week and the dept of revenue has not followed the courts order.

My mortgage is behind as well as other bills...my belief is that the dept of revenue is determined to make me loose my home and destroy my childrens lives

can I file some kind of motion to enforce this order and make the dept of revenue release my accounts immediately?

were can I go for help!  the workers in the dept of revenue said that they are GOD and to think of the judge as jesus...and the judge is subject to there wrath if he or she does something they dont like

this appears to be true I think i'm gonna take my kids and try to move out of this state i fear for my children and family

How do I get proof that the assistance was ever given to the NOW former custodial parent?

 the new custodial parent is trying to determine what part of the money the state is requesting for past due support is actual past due support, and what part is for repayment of assistance the former custodial parent alledgedly recieved?... for how long and in what form?

the new custodial parent just wants an accounting of what was actually given to the former custodial parent in assistance?

nobody just pays a bill just because someone says so.

the state may have been defrauded and the new custodial parent should not be responsible for re payment of that
