Do like someone else said:  keep all checking, savings accounts separate.  Do not mix funds.  Make sure each of you is the beneficiary on the other's accounts, life insurance polices, etc.

Unless he is voluntarily unemployed or underemployed, and only in extreme circumstances, can CA take your income into consideration.  However, do not ever reveal your income to the state of CA.

You need to get the order modified asking that you be relieved of your obligation of support to her since you've had custody for a year, and asking for support.

Child Support Issues / Finally!

These stories keep saying "studies show that children of divorced parents go to college less."  So what?  First off, I don't believe the "studies."  They are touted by NOW and other special interest groups and I've never seen one, muchless seen an unbiased one.

Children (really adults) have no constitutional right to go to college.  No one does. Finally, common sense prevails.

it doesn't matter that he's 16.  He is the father, he is responsible.  In most states, grandparents have no duty to support grandchildren, but parents at any age have the obligation.

Child Support Issues / RE: Property TAX idea
Jan 22, 2004, 11:58:36 AM
>Brief history had split custady for the last 6 years son with
>me Daughter with her. Be paying her about $300/mo. Son is now
>a 19YO HS grad, in the reserves, has a full time job and
>taking a few classes. X has filed for a CS MOD acording to NH
>guidelines my CS will go up by about %300.
>
>I am going to ask the court to deduct my yearly property
>amount from my income that he looks at for my CS obligation.
>It is quite outragious $4900/year =$95/week thats aprox %10 of
>gross pay. The way I see it, no the way it is is this is NOT a
>volintary expence/debt and should be treeted the same as
>income tax.

**Yes it is voluntary.  You don't have to own property.  You could rent an apartment.  It won't fly.

If the tax is not paid then the home goes away !

**The judge won't care.  The judge won't care if you live in a cardboard box.  You know that!!!

>FYI my daughter does have her own room with all that one would
>expect to find in a 10 year olds room and this space must be
>maintained and does not go away when my girl goes back to her
>mom. Anyone ever hear of this or try this if so did it work?
>It makes perfect since to me!

**Lots of kids sleep on couches.  Unless your state has a law that a child must have his or her own room during visitation, it won't fly.
>
>Any other thoughts on how to stop this giant CS increase?
>
>THANKS

**Keep fighting the good fight.  Can you still claim the older child as a deduction?  Are you still supporting that child?  Can you prove it?  I doubt it will work, but that's another avenue.  Also, if yours is a shared income state, increase your court ordered visitation and/or custody.

Child Support Issues / RE: My CS Beef

>So then you feel my pain. This is not right and it's going to
>catch up and bite America right on the a$$. The funny thing
>about my situation is that now my ex may have to pay back
>taxes and she's being told that the IRS will garnish her child
>support if she doesn't pay by a certain time.

**That's not true.  Child support is not considered income to the obligee.  The IRS cannot garnish it.  Even if she was collecting support from one person and paying support to another person, CSE cannot garnish it.  She's blowing smoke up your behind.

a job as a waiter/waitress at a bar or restaurant.  Some bars will pay you solely under the table....

a few months ago.  MI FOC has been in bad shape since day one.  CP's knew NCP's were paying but couldn't get the money from FOC.

Personally, I think MI needs to get off the weekly system, and go strictly to a monthly system.  It would unburden the system some.
