First may I ask why you would be thrown in jail??? My ex is over $20k in arrears and in contempt many many times and has gone to jail twice (for like a week) and that is only because he failed to appear in court for the umteen time.

Our CS worker give him chance after chance after chance and won't throw him in jail if he is ATTEMPTING to pay cs.  WHOOOO I got $18 in January.

Why can't you send anything (don't you have a checking account in the country you live in or can't family member wire some cs to the states)

Good luck.  I would probably call the cs office to see if your caseworker can work with you.

They set the cs on a calculation of salary or if not working they can inpute the income of what a person of that age/gender would make on the average.

My hubby was behind in CS and they took our income tax return, I had to file the injured spouse form and yes it does take about 8 weeks to get your money back. If you are behind in CS it is best to also file your injured spouse form at the same time to speed up the process.

The cs office hold the tax refund (a portion of it to see if a injured spouse form was filed.)

Did they have your current financial information and the amount of insurance you pay for the kids???

only a portion of it, as what the difference between a one and two bedroom are a PORTION of the utilities (we all know our kids leave every light in the house on)


I have no problem providing my ex with what I spend the cs on, hell I would give him copies of the receipts (if he paid cs)

I know some courts use it as to desiver (sp) whom the child(ren) live the majority of the time with.

Well I personally have no problem with it, I can show my ex how I spent the $25 I got last month.

$25 on food and travel for out of town basketball tournament (want receipts)

I know other custodial parents wouldn't do it OR they would just write crap down on a piece of paper like

$200 for rent
$50 for clothes
$50 for uliities
and so on.

BUT I THINK the debit cs cards are good, I think every custodial parent (me included) should have to us these, then at the end of the month give the NCP statement and it will show exactly what the cs and where it is spend.

But you know that would never happen.

I think to many custodial moms want to be in to much control and don't stop to think that the other parent would like to know how the money is spent on the kids, heck if you were still together you know darn well what you spent your money on.

But hey that is just me.

Don't get your hope up on her actually doing it or being honest.

§12-204. Determination of child support obligation.

 
(a) Schedule to be used; division among parents; maintenance and alimony awards. - (1) The basic child support obligation shall be determined in accordance with the schedule of basic child support obligations in subsection (e) of this section. The basic child support obligation shall be divided between the parents in proportion to their adjusted actual incomes.

(2) (i) If one or both parents have made a request for alimony or maintenance in the proceeding in which a child support award is sought, the court shall decide the issue and amount of alimony or maintenance before determining the child support obligation under these guidelines.

(ii) If the court awards alimony or maintenance, the amount of alimony or maintenance awarded shall be considered actual income for the recipient of the alimony or maintenance and shall be subtracted from the income of the payor of the alimony or maintenance under §12-201 (d) (2) of this subtitle before the court determines the amount of a child support award.

(b) Voluntarily impoverished parent.-(1) Except as provided in paragraph (2) of this subsection if a parent is voluntarily impoverished, child support may be calculated based on a determination of potential income.

(2) A determination of potential income may not be made for a parent who:

(i) is unable to work because of a physical or mental disability; or

(ii) is caring for a child un der the age of 2 years for whom the parents are jointly and severally responsible.

(c) Income between amounts in schedule.-If a combined adjusted actual income amount falls between amounts shown in the schedule, the basic child support amount shall be extrapolated to the next higher amount.

(d)Income above schedule levels.-If the combined adjusted actual income exceeds the highest level specified in the schedule in subsection (e) of this section, the court may use its discretion in setting the amount of child support.

(e) Basic child support obligation.-Schedule of basic child support obligations:

Gee sounds like someone I know.

Or the CP has more kids with different dads so the CP can get more and more FREE money.  I think the CP parent should have to pay taxes on the CS.  JMO and I am a CP mother.

My ex has 5 kids by 5 woman and doesn't support them.

My dh's case is different but I won't get into that as the LOVELY person and her friends used to stalk me here and hell they probably still do.

Look at it this way, usually when someone is getting a welfare grant ($$) they usually only get like a total of $50 cs a month, the rest of the cs that is paid goes to the state for support their fat asses and the children.

Now if for some reason she went off welfare then she will probably go after you for more support.

I did turn in a girl I knew for welfare fraud as she was living in low income housing and her ex was paying her $800 under the table (for ONE KID) so they finally caught up with her.
