You will not have to pay her alimony but the second husband may....it is what they come up with if they are civil to each other, if not it depends on your state laws and if they had a pre-nup.

What does the court order say about visitation now? If is spellls out exactly when then write her a letter that you plane on exercising your parenting time on XXX with both children. Send it certified....if he is denied bring her to court on contempt. What state are you in? Most states have a calculator that you can figure out what your support "should" be around. In my state for 2 children, it is 25%....Hopefully she will start to comply with the certified letter or when a judge tells her this is your parenting time. Why is she allowing the older child and not the younger one?

Hmm...I do not think I would trust her not to call CPS after the visit. How could she not know they were not talking? She HAD to ask your daughter questions over the past few years. It could ruin your son's teaching career. Maybe call CPS and see if they will keep a record of the letter or ask what they suggest? I would have your son go and ask a lawyer in his state for advice...tough situation to have to trust her. If he does see her, I would never leave them alone so nothing can be misunderstood. You are in for a long battle to change custody unless the mother agrees. The child has to move schools by either situation and she now has a sibling at BM house. If she moves, you can have her do the driving or meet half way. If you think she may not bring her you can go get the child for visits and then have her pick the child up. This way you know you will get child and then it is up to her to come get her. What is the mother offereing? I would go through the school calendar and ask for every long weekend (we have at least one a month) and all school breaks splitting the major holidays. There are some good long distance vistation plans on this site.  Good luck!

Hmmm....I am about 40 miles from you so our therapist would not be good for you. I would call the social worker at school and ask them for a name of someone near you. That is how I got mine name. Ask for a couple names and go and see them first. What do you have now on paper regarding visitation/custody? Will BM fight you if you want to bring them to a therapist?  How do you want to split the week? How does BM want it split? There are many people that have split custody on these boards that could give you how they do it..Good luck!

I am taking a guess here...but if you know which rentals she owns and possibly get paperwork stating that from the town then she should have to input that income THEN take away the duductions PLUS add her regular job. I would also fight that she is underemployed on purpose. Good luck!

Where in NY? What are you looking for this person to do? 50/50 is not that common here yet unless both parents agree. If you are in the same school district that is a big plus on your side. I have the name of my kids therapist (great with 25 yrs of experience) but she really is there for the kids and not to be called into court unless it is very necessary. Good luck!

You need to ask to modify your visitation. You can do it if you want and if it gets hairy then you can hire a lawyer. Where are your court papers orginally from? You need to go to where your orders were and ask for a modification at that court house. If it is not CA, you can petition CA to take control since everybody is living in CA now. Good luck!

If you have joint legal, then you can bring her to the therapist on your time just like the other poster said. I would also go and speak to the principal in person and let her know what you have heard and let her tell you her side of the story. If the school called CPS you would have been contacted already. They usually come to the school that day. Good luck!

In his divorce papers does he have a visitation schedule? custody papers? anything that went through the courts? If he does not, then he needs to go to the court house where the divorce was issued (and hopefully where child is still living) and ask for a visitation. You can look on this site for different ideas of what you want...long weekends...vacations...holidays...birthdays...Put times and dates in there so there is no confusion.
