... and none of them is a reason.

If all these excuses bother you so much, then you should have used them earlier to obtain custody and limit parenting of the mother.

I have had many opportunities to move away from my ex and obtain a better income and higher standard of living.
I never accepted.

I stand behind my opinion that custodial parents who want to move away should give up custody, unless the NCP has been deemed unfit.

FRESNO, Calif. (AP) — An 11-year-old girl charged with assault with a deadly weapon for throwing a rock at a boy during a water balloon fight was ordered to attend a mediation program with her young victim after her trial was scrapped in juvenile court.

Maribel Cuevas was prepared to face a felony trial Wednesday when lawyers reached a deal behind closed doors that allowed her to escape detention and avoid pleading guilty.

Cuevas was arrested in April for throwing a two-pound rock at a neighborhood boy who had pelted her with a water-filled balloon. The rock gashed the boy's forehead, and the girl spent five days in Fresno's juvenile hall and a month under house arrest after police said she resisted arrest and scratched an officer's arm.

Since then, the girl's behavior and law enforcement's response to it has become water cooler and editorial page staples far from Fresno. The girl's parents joined church leaders and the state chapter of the Rev. Al Sharpton's National Action Network in a vigil last week. They say the felony charge in no way matches her childish crime.

But Fresno's mayor and police chief say Maribel's case was handled appropriately, and that assault with a deadly weapon is the proper charge for an act that might have had fatal consequences.


MEDIATION?!?!?!? No charges, no record?!?!?? That's it????
Yep, she got away with it. Had it been the other way around, the boy would still be in jail, and no deal would have been offered.

FRESNO, Calif. (AP) — Advocates for an 11-year-old girl who was arrested on a deadly weapon charge for throwing a 2-pound rock during a water balloon fight say the charge in no way fits the crime.

But Fresno's mayor and police chief say Maribel Cuevas's case was handled appropriately, and that assault with a deadly weapon is the proper charge for an act that might have had fatal consequences.

The case was to go to trial Wednesday in the Juvenile Delinquency Division of Fresno Superior Court. In an unusual move for a case involving a minor, the trial will be open to the public.

Maribel was arrested in April for throwing the rock at a neighborhood boy who had pelted her with a water balloon. The rock gashed the boy's forehead, and the girl spent five days in Fresno's juvenile hall and a month under house arrest after police said she resisted arrest and scratched an officer's arm.

Lisa Bennett, a legal assistant for defense attorney Richard Beshwate Jr., said efforts to avert a trial were fruitless. "Even though there may or may not be good offers, having her plead guilty to a crime is not acceptable," Bennett said Tuesday.

(Note: I guess it was just a prank, huh?)


Alvin Harrell, the Fresno County assistant district attorney who supervises juvenile cases, said court rules prohibited him from commenting.

In a statement issued shortly after The Associated Press published a story about the case, Fresno Police Chief Jerry Dyer defended his department's actions.

"The simple fact is that we have an 11-year-old girl who struck a boy in the head with a jagged-edged, two-pound river rock, that required him to have stitches," Dyer said. "That is a felony, assault with a deadly weapon, and we are very fortunate that that act did not cause a more serious injury, even death."

Elijah Vang, the boy who was injured by Maribel and who has acknowledged throwing a water balloon at her, was expected to testify at the trial.

In the end, it will be his own fault. Wanna bet?

First of all, what is your current custody order say?

How hard is your attorney working for you? Did he file an ex-parte for you? Since your daughter lived for the last 20 months with you, your county has jurisdiction.

If your current custody order does not give you primary custody, you need to obtain an ex-parte custody order. Then you file child abduction charges against the mother.
Be prepared; letting her take the child for a month and a half without any action from your side will not look good.

Whatever you do, do it TODAY! If your atty doesn't get off his behind, be sure he is aware that you are his employer.

Give us more details about current custody order, and we can give better advise.

Video recordings are allowed without notification.

Audi recordings are allowed in many states as long as one party to the conversation (that would be you) is aware of the recording.

Do a search in the SPARC archives to find if your state is a one or two party state.

Read your custody order. It will likely state that the mother can delegate transportation of the child to any adult who is in possession of a valid d/l, insurance, and a safe vehicle. Should you want to be confrontational, you have the right to verify these documents...

If there is no custody order, or if the custody order does not state anything about transportation or who to transfer the child to, you have a completely different situation;
As long as your ex is not married to the guy, has given him power of attorney, he is a non-exisiting party.
Transfers should then be to her, and to her only. If she can't make the agreed time, then she should agree with you on a different time.

Also, check if you are in a one-party state to see if you are allowed to record conversations. If so, start recording.

Also bring a hidden camcorder and a witness to every exchange. If he lays a finger on you, you press charges against him (you have proof on tape), and file a TRO.

If you are "low-income", you may get some help from Friend of the Court. But don't count on it.

Ex Parte means an immediate emergency hearing without the other party present. Difficult to get unless you can make a plausible argument that your child may be in danger.

Keep in mind: your wife will screw you over in any way she can, and no place sees more lies than a court room. I.e. tell the judge that your wife is mentally unstable, and has mentioned to harm your child when in a situation like this.

Ask for the world, settle for less. Never ask what you want, because you won't get all you ask for. Ask for more to leave room for negotiations.

And yes, $250.00 is a reasonable fee for an attorney.

You can also go to Socrateaser's board and ask him how to file for an Ex Parte yourself.
