this is a more formal hearing than the one that you already had

you are driving yourself crazy reading the statutes and attempting to interpret them and forecast her next step

i will tell you her next steps.

she has to file with in 20 days (10 ) in my county for a hearing on exceptions.

this is not a trial but an appellate procedure the first step in PA courts.

she will file a paper requesting a hearing for exceptions to the interim order

she will provide you with a brief indicating why she feels she is entitled to a different amount and she has to list all the reasons.

then you have an opportunity to answer her.

she can also answer you

and so on and so on until the hearing.

the hearing takes place

a decision is made.

you then have the opportunity to appeal this decision.

not sure if you are allowed to tape phone conversations in NJ but if you are get her on tape with her big bad self ransoming her child.

i just finished a brief for someone that motioned for exceptions to a support order.

the interim order stands and the payroll deduction stands as ordered until a new hearing.

by the way it is very unlikely that she will get much more.

by the way i will happily help you prepare a response to her brief.

when you recieve it.

hi

here is a linc for you to document what a cna makes in your state.

you can also get lists of job opportunites at the unemployment office

news paper ,  call around and ask if they are hiring

to impute income you have to prove there is work available and how much they would make.

hi feeling crazy

i wanted to offer congrats and also ask where you found a PA statute addressing household income..

i have only heard of such a thing being ordered in circumstances of a NCP working part time or being voluntarily underemployed / paid or willfully not seeking employment

can you direct me to the statute you are refering to so i can explain it fully for you..

do not pay a penny more than court ordered ..
use that money to purchase a few things for the child.

send child back in the things she sends him in and keep your stuff at your home

 there are quite a few things you can do.

first of all send out a letter to her requesting her financials i am in the process of writing one of these for a friend so i can copy it to you.

when is your court date.. we need to serve her with in 3 weeks of it.

obviously you are mistaken  we pay 60 % of our net for child support and you need to do some research into how the child support guidelines came to be in place.  

non custodial parents were not supporting their children voluntarily.

I totally disagree with the methods used and the calculation but if there was no system at all in place far less children would be recieving any support at all.

I have to disagree with you on that one.

while i do agree that the whole entire system needs overhauled Child Support is mandated because it became necessary to enforce it.

there are way too many people that did take advantage of the system before the archaically styled one that is in place today became law.

You are what one would assume to be a responsible parent that is willing to take care of the child(ren) that belong to you.  There are far too many that are not willing to and had not been willing to when the system that we have in place today was written into law.

Unarguably the system is extremely flawed but it is a necessary evil that has helped many children see support from a parent that might not have contributed any thing.

God Bless you for being a caring enough parent that you know what is right and wrong.

(to the original poster...........  You as a step parent are not financially responsible for the child and in most states your income will not be taken into account when establishing a court order for your spouse to recieve child support that he is entitled to... If any thing he needs to apply for child support and put the money away for a college fund for kid.  Not collecting it is not a smart move if the child decides to move with the other parent when they are a teen and can make that decision i can guarantee you that they will seek support..

then it will be too late to have the support you should have gotten credited or offset!!!))))))))

we were just through a modification last year in Pa allegheny county to be specific.

what did you need to know?  i am quite familiar with PA statutes.
