Your stat bar association should be able to refer you to an attorney for a free, or low cost, consultation about your case.

Very useful and interesting Waylon. Thank you!

No sole custody means that the parent that has does not have to consult the other parent on major decisions and the other parent technically has no say in major decisions.

File the paper work today- if you are indigent (very poor) they may be able to waive the filing fee. You can also call the clerk of court (or look online in some counties) to find out what the exact filing fee would be as it can vary from county to county or state to state. I wouldn't be surprised if it was $150, I also wouldn't be surprised if it was less either, don't let sticker shock keep you from doing what you need to do.

File in court an emergency hearing to have child stay in the US..either with you or grandmother...?

absolutely- do so today- even without a lawyer, in the motion also request that the child not be removed from the jurisdiction until the court has ruled on the relocation.

I would not include granny as a possible residence for the child. You are mom- unless you have been found in some way to be unfit, there is no reason the child should not live with you.

if you can help your son afford a lawyer then he "may" have a better outcome in court- he needs someone who knows the system and procedures and who will fight for his rights. Unfortunately many people who represent themselves, do so at their own detriment.

Has he been established legally as the child's father? You said you were married after she was born.

If your son is being exposed to someone who has been proved to have abused him, go file an emergency motion for custody.

Natacha- please start your own thread so your issue can get optimal attention.

Is there another father to this child? Who is the legal father?

If you are not the legal father for the child you do not have many (or any) rights to see the child, some states - not sure about yours- do have statutes addressing third party visitation when that party has acted as the parent and is the "psychological parent" to the child- but for you to fight that battle- especially if mom (and dad) object will cost a lot of money or a lot of time and frustration educating yourself and proceeding pro se.
