Wisconsin State Forum / Shared Placement

           Need to hear from anyone in who has had experience getting equivalent overnight consideration from a court in determining their child support obligation. I live in Wisconsin, have joint custody with shared placement. I work third shift and have my child Tues. & Thurs. from school release til 8:00 pm, every other weekend from school release Fri. til Sunday at 8:00pm during the school year. In summer I have the same, plus Mon., Wed. , and the Fri. starting my ex's weekend from 9:00am til 4:00pm. I get three full weeks of vacation time each year and we alternate holidays each year. Wisconsin Law changed Jan. 1st this year and states that equivalent overnights count towards your number of days in figuring the the support amount under shared placement but my attorney says she has not been able to get this for anyone working a back shift, that the court is dismissing any amount of time that is not an actual overnight. The problem being that there is no where to be found a written definition or specific guideline that states what constitutes an equivalent overnight Has anyone dealt with this?

Someone asked where to find these definitions in Wisconsin statues. Can't find the original post. They're not in WI. 767, They're in Chapter DWD 40 which you can access on DWD's website.

What info can you direct me to about 1. Verbal abuse of child by step parent    2. target child syndrome - child refuses to be alienated from a parent and is verbally, emotionally, and physcologically punished for resisting  3. step parent goes to extremes showing favor to their own children in front of the target child. Any help would be greatly appreciated.

  I want to designate a percentage of my estate in my will to go into a trust for my grand-daughter, a minor. The trustee I want to designate is not a parent of my grand-daughter. The parents get their own percentage.We all live in Wisconsin.                                                     1. Could you give me an example of how this should be worded to prevent a parent having access to the trust or getting a judge to name either parent a co-trustee?

During mediation my exwife was court ordered to pay $600.00 of my attorney's fee since it was deemed her fault that we were there. The order reads that the ex shall pay $50.00 a month to XXX Law Offices for twelve months, to be paid in full by 08/01/2006.                                    The ex made 5 payments then stopped making payments. The lawyer is now a court commissioner, my bill is paid up except for the $350.00 still owed by my ex.                                                                                              

The office manager wants me to pay the bill and go after my ex in court for the money. I think they should do it since the court order says she owes the law office, not me, even though the account is under my name.                                                                                                                                                                                                      1. Should I send the ex a letter giving her a time limit to pay up?          2. If there is no response do I go after her for contempt or does the attorney's office have to do it?

My ex was scheduled to turn over her financial info on April 30, for a yearly C.S. review (I am payor, she is primary residential), of course my attorney received nothing and the ex wouldn't take her phone calls or answer letters. My attorney scheduled her, by court order for a financial deposition this past week. The ex sent a relative to pick up our child from me and take the child to her at a 5 day music festival the day before the depo. I called my attorney the next day at the scheduled time of the depo thinking she finally sent the info. They were waiting for her at that time. No info received, no call to reschedule. They have a certified signed receipt to prove she was served.  I informed them of her whereabouts. Needless to say, my attorney is furious! My attorney is filing contempt on the ex.  Our C.S. modification hearing is the middle of next week.                                                                                               1. What CAN the judge do to her?                                                       2. What is most likely to happen?                                                   State of Wisconsin, Joint legal & physical, shared placement

Both parties in state of Wisconsin. Original divorce decree (1997) states exactly- The Petitioner (father) has the right to claim ***** (younger daughter) as a dependant and exemption on his returns for 1997 and in all future years.  (This was done because the parents did not marry until 1993 and the mother had taken the older daughter as an exemption every year. )                                                                                               The Respondent (mother) has the right to claim ***** (older daughter) as a dependant and exemption on her returns in 1997 and in all future years.                                                                                                   Older daughter turned 18 and graduated high school this year. Went in front of Family court commissioner for child support modification and she ordered that the father can now only take every other year and only if he pays over $9000.00 that year in child support. If he doesn't the mother gets it that year also.  Have requested a De Novo hearing.      1. Can a Family Court Commissioner ignore or rewite the original judge's order when it is worded this way?                                                2. Any chance the judge at the De Novo will reinstate the orginal order?  Thanks for any advice.

All parties in Wisconsin, Shared placement custody & support, Father is to receive five weeks vacation with child yearly, Mother has only allowed two weeks. Keeps refusing all other requested weeks.     At recent child support hearing in front of court commisioner mother got the three weeks she denied taken out of the accounting for overnights. Court commissioner said if he has not taken them before the hearing they don't count. Court commissioner then raised the father's monthly gross income from the actual amount of $3700.00 to $5000.00 for figuring child support because in the past he had worked overtime even though he is not allowed to now on Doctor's orders. (Have filed for a Denovo Hearing.)  1. In the statute on shared placement isn't there a section stating that court ordered placement time, when denied, still counts for the denied parent?       2. Anywhere in the Family Law or DWD 40 Statutes?

All parties in Wisconsin. Submitted request to medical group for copies of my daughter's medical records and billing records. Told because she is almost 18 years old I must get a RELEASE FOR PERSON ALMOST 18 signed by daughter. I have joint legal and physical custody with shared placement. Mother has refused to share any medical information of any kind with me. All I ever see is the statements from the health insurance I carry on her. No info there except how much they paid and how much is owed. Mother has refused me all placement time since 11/98. I have had two contacts with child in all these years. One e-mail last Dec. 22nd, calling me an a**hole and telling me that I was not to send her anymore gifts or presents, as they would be refused. One message through my younger daughter, who is here daily, that she would let me buy her a flat screen lap-top computer for her graduation, and SEND it to her. We live exactly 2 miles away from each other. Despite many mediation attempts(5 a year,each year), the courts here have refused to enforce their own court order or sanction the Mother.                                                                                           1. Have you ever heard of a special release form for someone almost 18 yrs. old?           2.  Can they refuse to give me copies of her records if they receive a legal request with a copy of the court order showing joint legal and physical custody?

Do you know of any other states that also use a Shared Placement formula?                                                                                                                                                                                                       2. Do you know of any state that has a definition in use of equivalent overnights?

Visitation Issues / Motion to Clarify CO

Saw that someone had mentioned a Motion to Clarify. Forgot to print it. Can anyone tell me where to find a blank? BM is screwing with vacation time, regular placement time, picks up child 20 to 90 minutes late with no phone call despite her setting pick up time! Thanks for any help!
