My dh has been out of work since the beginning of Nov.  This is the first time he's not paid his child support in the 5 years DSD has been alive.  He owes a little over $1000.  He got pulled over a couple weeks ago for accelerating too soon and found out his lisence had been suspended!  Therefore he got a DUS.  We got the letter stating it had been suspended the next day.  Talk about bad luck, I know.  But they should've told us in advance right?  My main question is does anybody know what the law is as to how they decide when to suspend your license?  Is there a certain amount of money you have to owe or a certain amount of time that has passed or is it case-manager driven?  If it's case-manager driven I'm gonna be pissed cuz I know she doesn't like us since I've caught her in 3 different mistakes where they've said we owe money we don't owe.  Anyway, if anybody knows, let me know.  Thanks so much!

Hi.  We live in Ohio.  My DH has a new lower paying job (DH was laid off from the other one and there's no decent paying factory jobs around here anymore) and child support is now taking exactly 1/3 of every paycheck after taxes.  It's killing us financially.  We would like to get it lowered but we don't want to end up worse than before.

Here is how our situation has changed since we last set up CS.  When CS for DH's DD was set up 5 years ago DH had a job where he made $11 an hour and now he has one where he makes $9.50.  We were not married now we are.  DH and I now have a child together.  What hasn't changed is that the BM still stays at home and lives off child support and her husband's income and we still have just your normal run of the mill EOW, EOH visitation.

Will they take my income into consideration now that we are married?

Will they take into consideration DH has our child to support as well as DD now?

Will they take into consideration that DD's health insurance is through DH (BM doesn't carry it on her), actually it's through my health insurance which allows me to carry step-kids?

Will they take into consideration that we pay rent for a home big enough for DD to have her own bedroom and she also has her own wardrobe and toys at our house (and always has)?

Is it worth trying for?

How do you get the judge to order them to do that?

My dh is behind in CS so they garnished our tax return.  No big deal except they did not immediately apply it to his arreage.  They say they have to wait 6 months because, as his spouse, I have 6 months to fight it.  I don't want to fight it but there doesn't appear to be any way for me to make that clear to them.  So there is $1900 out there just floating around.  BM doesn't get it, we don't get it.  It's so stupid I could scream.  Anyway, we plan to have at least half of what he owes paid down way before the 6 months is up.  I don't think we will owe nearly $1900 by the time they can apply it.  So my question is what happens to the money that is left over from that $1900 after they apply what's necessary to clear his arreage?  Say there's $500 left over.  Will we get that back or will they credit it to his account or what?  BTW, we live in Ohio.  Thanks!

Hi.  My DH lost his license in Feb because he lost his job and hadn't paid support for 3 months.  His CSE case manager is a witch, he wasn't even $1000 behind.  (I've caught her in two mistakes saying we owe money we don't and she seems to hate us since then).  Anywhoo, that's besides the point.  He finally found a job.  He calls the case manager and asks what he has to do to get his license back.  She says she wants half of what he owes.  We won't be able to pull that off for at least a couple weeks.

We live out in the country so taxis or public transportation are not options for us.  Also I will be at work during the time he has to drive to and from work.  The only option is for him to drive without a license which we hate to take that chance but he has to keep this job!  It took so long for him to find it!  The economy sucks around here.

So he asked if he could at least have work driving priveleges but she said no they don't do that.  I don't understand.  Even people who lose their licenses for driving infractions often at least have work priveleges!

Is she full of it and just telling my DH this because she always wants to give us a hard time?  Does anybody out there know more about this than we do?  Any input would be great.  I will fight her, go to her supervisor or whatever, if I know there is a point to it but if there is no point I'd rather not fight because she hates us enough as it is.  Thanks so much!

BTW we live in Ohio.

Mixed,

I do see your point but when my son is having to sleep in my room cuz we can't afford a place with a 3rd bedroom.....something is off-balance!
And meanwhile BM is preggo with her 3rd child (on purpose), has two nice vehicles, an RV, and owns her 3 bedroom house.  Hmmmmmm.

We really feel that DSD should have her own clothes to wear when she's at our house (as well as her own room, toys, food, etc).  But it really drives me crazy that we are also paying for all these things at BM's house too.  And she gets the privelege of having DSD in her home at least 5 times as much as we do.  It just doesn't seem fair.  I could see if money was the only thing DH wanted to contribute to DSD's upbringing.......but it's not.  We'd take her all the time if we could!  And we wouldn't even care about being paid CS to do it!

I've had people tell me that since DH and I recently had a baby that he can get his CS lowered b/c now he has to support our DS too.  Any truth to that?  Our finances are really tight now and my DS doesn't have his own bedroom cuz we can't find a decent 3 bedroom home to buy that would fit the budget forced on us by the CS.  Everybody DH works with who also have to pay CS think we're paying too much as it is.
