well that's kinda what I did, asked for me to keep him but, ....
it's always a no, ...

I know what you mean though, I will have to sit on that decision and maybe request the time thru her lawyer a couple of times to make it official and then, ... see to file a change, ...

Hi,
Last night I discovered that my ex, picked up my kid at my place as it says in the order and then take him to her home (where her mother lives as well) put our kid in bed and 10 minutes after goes to her Boy Friend's home to spend the night (the grand mother take the kid to daycare in the morning).

I also discovered that on sunday, she works, noon to 8:30 pm and doesn't even bother comming back home to her mother's home where our kid is because he is already sleeping and prefer to go see her BF.

Bottom line is: why can't she then leave our kid with me ?!?!
what can I do for that? our court order state that I have the right of first refusal but it also talks about her having to ask me for 1st refusal if she can't take care of our kid for a day (technicaly she is gone for less than a day, ...)

any thoughts?

I did that in the past but she said she received a letter with nothing in it and accused me of submitting a letter that was actually not inthe letter to get away with it.

See, I am kind of on the other side of you.
I am the one that gives notice and all but she is the one that file for contempt saying she never got it.

When the judge ruled on the contempt issue, what was he /she looking for to make his/her ruling? non denied proof?
Was she guilty unless proven or was she not guilty unless proven ?

What was the train of thought of the judge ?

I understand.

There doesn't seems to be any sense in mine either, ....
1- She simply said I denied her visitation.
2- I say and show letters I gave her, telephone record, even a letter she signed.
3- She say she never got the letters and I forged her signature, ...

What a mess, judge said this is "he say she say"....

How long were the hearing on each contempt ? long? did you both have to testify as well as the gard that made the report, .... ???

could you tell us more on what made the difference for you to win that contempt or is it that she was found in contempt many time and you only once ?

Hi,
My divorce decret state that it's up to each other to arange kids pickup.
I am now living with girl friend for over 1 year.
I would like to have her pick up my kid since it's close to her work but I am anticipating that bm ex will put a fit so I am looking for a letter type to Ex to tell her GF will pick up kids and another letter type for GF to keep in her car in case police is called that would show that I give her all power for medical and all
