I posted in the thread below "Please help me address this issue" and was wondering does this apply to us or others in our situation:

TEX. GOV'T CODE ANN. § 403.0551 (Vernon Supp. 2000) authorizes the Comptroller to offset state payments against a person's indebtedness, delinquency or default. The Comptroller is also required to issue a payment to the person for any remaining amounts after an offset, referred to as an overage.

On or after the 31st day, the payment is offset, where the held warrant is applied towards the liability. The Comptroller's office will update TINS, and will deposit the money into a Treasury fund for the hold source agency. This agency is then responsible for transferring the funds as described below. In the event of an overage, the Comptroller's office will issue a separate payment to the payee.

Overages

When an offset exceeds the amount of the payee's liability, the Comptroller's office will issue a separate payment to the payee for the overage.

As an example, a single held warrant that exceeds the liability amount will be deposited in two separate funds: The amount of the debt will be deposited into the hold source agency fund 9016 as described above.
The balance will be deposited into a Comptroller fund from which a purchase document will issue an overage payment to the payee.

Child Support Offsets

Family Code § 231.007 (c), (Child Support) Debts to State, explains that the Office of the Attorney General (OAG) is the sole assignee of all payments held due to a child support liability. Therefore, the OAG will decide the outcome of their held warrants.

There are two specific release reason codes assigned to the OAG:
Release reason code 020 means that the warrant was released to the OAG to be offset. The OAG processes their own deposits for 020 releases and issues their own overage payments when necessary.

Release reason code 021 means the warrant was released to the issuing agency because the OAG consented to its release. The issuing agency should forward the warrant to the payee.

However, getting the Texas AG's office to DO anything like they are supposed to is tantamount to moving mountians with a teaspoon.
