I live in Texas and am the NCP and am  a good one, I have taken my daughter tons of extra time and faught and won for extended standard visitation but due to an error on my part paid cash for child support for 2 years and now owe x-wife 5000 dollars which i have paid 2500. Now she wants to take me back to court to have my new wife removed from xtra curricular activites and says she is harrasing her and doesnt want us to cut my daughters hair, or attend activities not on our weekends and only call between the hours of 7-8 when she doesnt even call during those times to my house and rarely ever even calls my house to talk to my daughter.
My new wife and I have registered my daugher for school 2 out of 3 years taken her to all of her dental appointments for 3 years, gotten her a winter coat for 2 at her moms house, paid for half of  extra curricular activies and not to mention have her in counseling which my x wont take her to if it falls on her day and for the past 2 years has had at least 7 unexcussed absences each year.  But this year the ex wife is trying to be mother of the year and is team mom for cheerleading and had me and my wife thrown out of the flage football game for  me wanting to participate in her homecoming game....
Can someone tell me what Judge is going to listen to me the father who doesnt have the money for a lawyer when the x wife takes us back again? I do the best I can to be a good father and I get to pay another 1500 dollars for lawyer fees yea!
Does anyone have advice?

At least you aren't in Brazos County like we are.  Its like living in the Family Law Black Hole.

Best of luck to you!

Try and contact an Father's Rights agency in Texas that can possibly help you.  I talked with a agency out of Houston and they seemed to help a little, but my case is a little more extreme than the usual case.

As far as all the petty stuff that the EX is gripping about, if I am understanding the info right.  If it is not specifically stated in your court order those things she is complaining about, then she has no leg to stand on in court.  It is her purden to show proof of all the things she is accusing you of and you wife of.

Now the cash money thing, sorry to be so blunt, but that was stupid on your part.  The only way you could possibly prove this is to take your bank records of when you pulled the cash out to pay her.  If it is close to the amount and time the child support is due, the judge may accept that as proof on your part, but that is even stretching it.  Now if you could possibly find a third party with no interest in the case to testify that you paid the money, that would be great.

I hope this helps.

hey bradley, I'm in Dallas County?  Do you know who your judge is for your case?

I've been to court many of times in Dallas county and I think they are pretty fair to the dads, but I mean fair.  They don't lean one way or the other.  So, as far as being worried that your in a biased court room in Dallas County I don't think you have anything to really worry about it.

My heart goes out to you.  I don't have any advice unfortunately.  I suffer from not seeing my child because mama won't let her come.  I pay my child support through the state and it doesn't matter.  She get's her money, I get no visitations.  REALLY FAIR! (not).  I hope someone does have an answer for you.

Best of luck.

Take care

We are in Wiciita County. You might want to talk to Bruce Martin. he is in Wichita Falls but worth the trip. He is a father & very father oriented. My son's ex's lawyer quit when he found out we had changed to Bruce. He said that he had never won a case against Bruce so there was no use continuing. Bruce is a board Certified Family Law & Custody Specialist. He does a lot of cases in Dallas.

If nothing else, make an appointment & run it by him. He doesn't charge for the first appointment. Often a letter from him can cause an attorney to have the opposition rethink their options.
