The ex has turned Child Services on me in FL in Brevard county to raise child support as punishment for trying to see my kids. I have to prove my innocences in court and dig up reciepts/canceled checks from 4 years ago they claim I owe back child support from before I started paying through the state. She knows I am up to date on the payments but she stated if you have the reciepts, dont worry. I know she is hoping I cant find them all. She has also been denying me vistitation and has violated the decree twice. The decree is bad due to it being a out of state decree and she moved back. The issues started when I wanted to see the kids more tham everyother weekend, like we were doing while I was renting rooms. Now I have the space for them, she started, she has to have it her way or no way and claims it is best for the kids.
We are also going to court over her assualt charge when she hit my wife in the face in front of the children when we were picking them up. I dont have money for a 3 way legal battle. Can anyone direct me for assistance, I need lawyer but coming up with a lump sum is the problem. I can make payments.

any help is appreciated,

Thank you

Good luck with all of this. Call your bank and tell them you need copies of those checks. Depending on your bank they will either work with you and look only for checks for that specific amount if you don't know the check #s or they will make you pay for all cancelled checks for the past 4 years. We went through a similar situation 6 years ago with PBFH raising CS. She had gotten on welfare and CS enforcement got involved. We payed a pretty penny for all of our cancelled checks as proof but they decided that since the checks went straight to the mother and not their office that they were gifts not CS and made DH pay back support. Just got done paying that off a few years ago. As far as a lawyer goes, what state are you in (I know a good and fairly priced lawyer in NY)? Get out the phone book and just start calling them all and ask them up front what their retainer fee is for your situation.

What state is this in? One of the members here will more than likely know a attorney that can work with you.

One of the first things you'll hear around here is "Document, document, document!". Having good records is *crucial*. Get yourself either the Parenting Time Tracker (PTT) at: http://www.deltabravo.net/custody/tracker.htm or the OPTIMAL Custody Tracking service at: http://www.parentingtime.net. The PTT is good, but the OPTIMAL service is definitely better.
