In my State, .004 can hurt a CDL license, but to be legally drunk, it is .008.

Any way you can check your DUI laws?

Sounds like she has a fighting chance on this...

It's zero tolerance for under 21 in CA.  The driver was exactly one week away from her 21st birthday.  I think they changed it from .10 to .08 here also.   However, I spoke with her, and she knows that road.  It is famous for fatalities. She was doing 60 in a 55.  For the most part, it's a straight two lane country road, with no lights.

It all depends what kind of lawyer you have.  OJ walked, right?
