All things unequal. If I'm already sure I'm going to end up back in court.  Is it better to be on the offense?

Not really, unless you're in a jurisdiction where the first person to file can pick the judge by getting a temporary order signed. This would  apply to both the first motion in the case and the first post-judgment motion.

Otherwise, there's really no particular benefit in a family law action.
